스포츠산업 진흥을 위한 법적 고찰

Legal Consideration on the Sport Industry Promotion

오늘날 스포츠는 첨단과학과 결합하여 산업으로의 발전에 무한한 가능성을 가지고 있다. 이에 우리나라의 스포츠산업을 발전시키기 위한 스포츠산업 진흥법이 제정되어 시행되고 있지만 법의 구성내용이나 지원에 대해서는 아직 다른 산업분야에 비하면 미미하다. 이에 지역의 산업을 발전시켜 지역경제 활성화와 산업의 특화를 위해 1997년부터 조성된 테크노파크의 법적인 근거를 마련한 산업기술단지 지원에 관한 특례법을 고찰하여 스포츠산업 진흥법이 나아가야 할 방향 그리고 스포츠산업을 발전시키기 위해서 정책들을 펼치기 위해 산업기술단지 즉 테크노파크처럼 기술 및 자본, 인력의 집약으로 고부가가치를 창출해내는 데에 밑바탕을 준비하는 것이 필요하여 스포츠산업 진흥법과 산업기술단지 지원에 관한 특례법을 비교 고찰한 결과 다음과 같은 결론과 시사점을 얻었다. 첫째, 스포츠산업 진흥법과 산업기술단지 지원에 관한 특례법의 구성과 지원내용에서 차이가 있는 것으로 나타났다. 자금과 인력에 관련하여 스포츠산업 진흥법은 개괄적인 내용으로 조항이 구성되어 있는 반면 산업기술단지 지원에 관한 특례법은 구체적인 지원 및 방안을 제시하는 내용의 조항으로 구성되어 있다. 이러한 구체적이면서도 확실한 규정의 제시는 정책을 펼쳐나가는데 큰 밑바탕이 될 수 있으므로 스포츠산업 진흥법도 개정을 통해 명확한 규정을 제시할 필요가 있다. 둘째, 스포츠산업진흥시설, 스포츠산업지원센터의 지정과 설립을 구체화하여야 한다. 산업기술단지 지원에 관한 특례법에 나타난 조성에 대한 조항은 조성계획 수립 및 절차, 시행자의 지정 및 취소, 구체적인 사업내용, 운영지침, 평가, 공장설립, 시설, 비용, 임대 등의 구체적인 지원내용을 명시하였다. 스포츠산업 진흥법의 내용은 진흥시설 및 지원센터 지정에 대한 기관의 요건만 제시하였을 뿐 구체적인 지원 내용과 명확한 규정을 제시할 필요가 있다.

This study is combining sports with advanced technology has unlimited possibilities in today s sports industry. To develop the industry, the Sports Industry Promotion Act was established but the contents of it s organization and support are insufficient in comparison to other industries. The Act on Special Cases Concerning Support of Industrial Technology Complexes provided the legal basis for Techno Park, which was built to develop regional industry, boost the regional economy, and specialize the industry. After comparing the Sports Industry Promotion Act with the Act on Special Cases Concerning Support of Industrial Technology Complexes, we found that the best way for the Sports Industry Promotion Act to go forward is for it to prepare a detailed foundation for getting high added value with intensive technology, capital, and labor, just like the Act on Special Cases Concerning Support of Industrial Technology Complexes did for Techno Park. First, there is a difference in both form and content regarding the application between the Sports Industry Promotion Act and the Act on Special Cases Concerning Support of Industrial Technology Complexes. The Sports Industry Promotion Act consists of recapitulated contents on funds and labor, whereas the Act on Special Cases Concerning Support of Industrial Technology Complexes consists of specific and detailed supporting plans. Proposing these specific and detailed supporting plans can supply a firm foundation in directing how to carry out this policy. Therefore, the Sports Industry Promotion Act needs to be revised to propose specific and detailed regulations. Second, it needs to give shape to the designation and establishment of sports industry promotional facilities and sports industry support centers. The Act on Special Cases Concerning Support of Industrial Technology Complexes specifies specific and detailed supporting plans such as formation plans and procedures, designation of specific implementer and cancellation, detailed business contents, guidelines, evaluations, establishment of a factory, facilities, funds, and leases, etc. The Sports Industry Promotion Act proposes only the promotion facilities and the requirement of institutes to be designated as support centers. For these reasons, it must propose more specific and detailed supporting plans.
