浅析中国职业体育主体间的法律关系

중국에서는 스포츠프로화의 급속한 발전에 따라 프로스포츠의 운영과정에서 각종 모순들이 나타나고 있으며, 이에 따른 법률상의 문제들도 많이 발생하고 있다. 따라서 학자들은 프로스포츠란무엇인가, 프로스포츠의 시장화운영과정에서 각종 주체들간의 법률관계를 어떻게 이해할 것인가,업종별 스포츠협회가 프로스포츠에서 차지하는 역할은 어떠한가 등 문제에 대하여 많은 관심을 가지고 있다. 이와 같은 문제의식하에서 본문은 주로 프로스포츠의 업종별 스포츠협회, 구단, 선수간의 법률관계에 대한 분석을 통하여 이러한 문제들에 대하여 비교적 명확한 견해를 제시함으로써중국의 프로스포츠 관련 입법에 개선의견을 제공하려고 한다.

With China s rapid development of professional sports, various contradictions have emerged,also brought legal problems. What is professional sports? How to locate the relations of thesubjects of the Professional sports when in the process of market operations ,and what is therole of sports federations in its activities, are the common concern of scholars. In this articlethe auther analyze this issue mainly from the angle of the legal relations amongprofessional sports federations, clubs and atheles. Strive to have a more clear understandingand expectation for our professional sports legislation to provide a reference. 我国体育职业化的快速发展，各种矛盾相继凸现出来，也带来了法律上的问题。什么是职业体育？ 职业体育在市场运营过程中各主体的法律关系如何定位，单项体育协会在其活动中扮演的角色，是学者普遍关注的问题。本文作者主要从职业体育单项体育协会、俱乐部、运动员之间的法律关系进行分析，力求对此问题有一个较清楚的认识，并期望对我国职业体育的立法提供参考。
