문화재보호법과 전통무예진흥법의 무예진흥에 관한 법제도적 소고

The Cultural Properties Preservation Law and the Traditional Martial Arts Promotion Law: A Legal Analysis for Promotion of Martial Arts

문화재보호법에서 중요무형문화재 제76호로 전통무예인 택견이 1983년 지정되어 국가 문화유산으로 보호받으며, 계승 발전되어오고 있다. 이후 2008년 법률 제9006호로 전통무예진흥법이 제정되어 전통무예진흥을 위한 국가 및 지방자치단체의 지원에 관한 법적 근거를 마련하여 우리의 전통문화를 되찾고 나아가 국민의 건강 증진과 문화생활 향상 및 문화국가 지향에 이바지하고 있다. 본고에서는 전통무예의 문화재보호법상의 중요무형문화재측면과 UNESCO의 「무형유산보호협약」(Convention for the Safeguarding of the Intangible Cultural Heritage)에 인류무형문화유산으로서의 전통스포츠와 놀이의 의미와 함께, 전통무예진흥법에서의 전통무예진흥을 통한 문화적․스포츠적 가치를 살펴보고, 전통무예의 무형문화재로서의 측면과 전통무예진흥으로서의 2가지 측면에 대한 법제도적 고찰 및 개선방안을 제시하고자 한다.

Taekgyeon, a traditional Korean martial art, has enjoyed the recognition it deserves as part of cultural legacy of Korean people since it was designated as an intangible cultural property of great impotance No. 76 under the Cultural Properties Preservation Law in 1983. This milestone designation was followed in 2008 with the enactment of the Law No. 9006 of Traditional Martial Arts Promotion, which requires the central and local governments to play more aggressive role in preserving and promoting the best and the brightest of the traditional Korean martial art as a part of the Korean cultures, thereby providing quality services to the citizens in the field of welfare sports, public health, and cultural opportunities. This study first takes a broad review of the values and roles of traditional martial arts not only as cultural properties under the Cultural Properties Preservation Act but also as traditional sports and plays, a significant part of cultural heritage for all humanity under UNESCO s Convention for the Safeguarding of the Intangible Cultural Heritage and the Traditional Martial Arts Promotion Law. Then a practical proposal for promotion of martial arts is put forward from a legal and institutional perspective, with focus on two unique aspects of Taekgyeon: traditional martial art and cultural property.
