일본 니혼TV의 김연아 선수 도둑촬영 사건을 계기로 본 보도의 자유와 프라이버시 침해

Freedom of Press and Breach of Privacy

이 글은 일본 니혼TV의 김연아의 도둑촬영을 계기로 본 보도의 자유(엄밀하게 말하면 이의 전제로서 취재의 자유)와 프라이버시와의 관계를 다루고자 하였다. 따라서 일본 니혼TV의 도둑촬영은 정당한가라는 관점에서 국민의 알권리와 김연아 개인의 프라이버시와의 충돌 및 그 조정을 주제로 하여 Ⅱ에서 김연아선수가 공적 인물에 해당하는가, 해당한다면 공적 인물인 김연아선수의 프라이버시는 인정되는가, 인정된다면 일반인과 마찬가지로 인정되는가, 아니면 제한되는가, 제한된다면 어떤 기준으로 어디까지 제한되는가에 관해 미국과 독일의 이론을 비교법적인 측면에서 살펴보았다. Ⅲ에서는 일본 니혼TV의 김연아선수에 대한 도둑촬영이 국민의 알권리를 충족시키기 위한 것으로서 정당성이 있는가라는 문제를 직접적으로 다루기 위해 도둑촬영이라는 취재행위자체의 정당성, 이것은 특히 프로서의 프라이버시 침해 유형 중, 제1유형인 사적공간과 생활의 침입(intrusion)에 해당되므로 이에 대해 살펴보았다. 즉 프라이버시권을 침해한 취재행위에 대하여 프로서의 4가지 유형중 제1유형에 해당하는 침입불법행위로 규제하는 것에 대한 타당성여부 및 그 문제점과 개선방안을 검토하였으며(Ⅳ), 마직막으로 언론기관의 위법한 취재행위로 인한 프라이버시침해시 사법적 구제수단으로서 손해배상, 원상회복, 사전금지청구권에 관해 고찰하였다(Ⅴ).

In recent modern countries, it is the domain of the conflict between privacy right for public figures and freedom of press that most frequently requires the application of the principle of equity than any other domains. Altough the fundamental rights are indispensible to modern societies, they are also oppositional in their characterisitics and the privacy right for public figures often causes the conflicts with freedom of press as exercise of the people s right to know. Privacy right was once though as passive meaning like right to be alone , but it was developed to active right, constitutional right, the right of an individual to control the acquisition, disclosure, and use of personal information in the U.S. in 1960s. Nowadays, however, the internet is growing at a rate that outpaces any modern medium of communication in collecting and processing personal information. Especially, the infringement of personal information on Entertainer such as sports player, acter, singer etc. is constantly emerging with technologic development. Thus, this article examined some problems on the right of privacy in civil law.
