학생선수의 학습권에 대한 헌법적 함의

The Constitutional Implication for Student Athletes of Their Rights to Learn

최근 학생선수들에 대한 학습권 문제가 단순 사회적 문제가 아닌 그들의 기본권 침해 문제로 발전되면서 헌법적 문제로 대두되었다. 그래서 국가인권위원회에서는 학생선수들의 인권상황 실태를 조사하여 발표하였는데, 그 심각성이 매우 놀랍도록 기본권 침해가 이루어지고 있었다. 이에 대해 인권위는 학생선수들의 기본권 보장을 위해 권고조치 하였고, 특히 학생선수의 학습권이 크게 침해되고 있어 이에 대한 방안으로 정부와 관련기관에서 몇몇 대책을 제시하였지만 실효성을 거둘지는 의문스럽다. 학생선수의 학습권은 수업을 듣고 못 듣고의 문제가 아니라 그들의 직업과 연관되어 있고, 그로인한 풍족한 삶까지 영향을 준다는 차원에서 생존권과 인간다운 삶의 문제도 함께 고려해야 한다. 하지만 정부의 대책이나 몇몇 관련 논문에서는 학생선수의 학습권 문제를 단순히 수업권 보장차원에서만 접근하고 있어 학습권이 가지고 있는 의미를 축소하는 것은 아닌가 우려스럽다. 따라서 본 논문에서는 학생선수의 학습권 문제를 헌법적 차원에서 되짚어 보기 위해 학습권 관련 헌법 조항을 재해석하고 이와 관련된 다른 기본권들을 살펴봄으로써 학생선수의 학습권 문제가 단순한 학습권 보장의 문제가 아님을 강조하고자 한다. 그리고 정부나 관련기관에서 앞으로 학생선수의 학습권 보장에 관한 대책이나 방안을 고려할 때, 그들의 학습이 직업교육적 의미도 함께 가지고 있음을 고려하여 좀 더 효율적이고 현실적인 대안을 제시하기 바란다.

In recent year, the violation of the human rights of student athletes has been raised as a social and constitutional issue. In 2008, the National Human Committee conducted research on the actual conditions of human rights violation in sports domains, including violence. The result turned out as shocking. Student athletes in middle and high schools were being seriously deprived of their rights. An immediate and necessary improvement is required. Therefore government and social sectors have devised various resolutions but they do not seem to provide the optimal solution. The reason they failed to provide the proper solution is that they only focus on the students rights to learn. The problems include not only the right of learning but also other rights such as the right to equality, the freedom of choosing job, and the right to pursue one s happiness. However the most of article, thesis, and paper mention only the right to learn without other rights related to it. It is advised to be aware of the implication of the rights to learn for student athletes since the rights would be led to enrichment of life, democracy, cultural and social nation. In order to prove the complexity of the rights to learn which is associated with other human rights, it would be studied in the perspective of constitution. Measures to assure the student atheletes rights to learn would be presented after further research later.
