국내 스포츠법률 현황 및 변천과정

A study on the present situation and changing process of the sport law in Korea

우리나라 스포츠법률의 실태를 파악하고 나아가 스포츠정책 운용 및 스포츠관련 법제 연구에 도움을 줄 수 있는 기초자료를 제공하기 위하여 현행 제정 법률을 대상으로 스포츠법률의 현황 및 변천과정을 고찰을 한 결과를 보면 다음과 같다. 첫째, 우리나라 전체 법률에서 스포츠법 영역에 포함할 수 있는 법률은 모두 25건으로서 전체 법률 대비 2.15%에 불과하며 법제 분야에서의 스포츠법제가 차지하는 위치는 현재로서는 아주 미비한 것으로 나타났다. 둘째, 소관 부처 외에 산재해 있는 스포츠관련법 중 스포츠 정책과 운영의 일관성과 효율성을 높이고 종합적인 관리체제를 구축하기 위해서는 유사성격의 법률 특히 15건의 스포츠법률의 소관 부서를 문화체육관광부로 일원화할 필요가 있다. 셋째, 스포츠법률의 구조적인 발전을 위해서는 기본이 될 수 있는 행정정책관련법이 제정되고 이를 근거로 파생법적 성격을 가진 시설법과 운영법이 제정되면 법적 안정성을 가져올 것으로 기대된다. 넷째, 정부 제출에 의해 제정되던 스포츠법률은 국민정부 이후 대부분 의원 발의에 의해 제정되고 있는 것으로 나타나 스포츠정책 및 운영이 정부주도형에서 민간주도형으로 전환되고 있음을 보여주고 있다.

The purpose of this study is to provide basic data which are helpful to development and identity establishment of the sport law and we have the results as follows by investigating the present situation and changing process of the sport law in Korea First, the investigation showed that sport act account for 25 cases(2.15%) of total 1,162 statutes of Korea. Those are proving that sport act still holds an insignificant standing in the whole statutes of Korea. Second, for efficient implementation and synthetic administration of sport policy, the law classified by sport law(15cases) should be integrated management into Ministry of Culture, Sports and Tourism. Third, for legal stability and structural development of sport law, administrative law must establish preferentially. And based on this, facilities and management law must establish. Fourth, the investigation showed that sport law establish by government -initiated bills but since the People Government establishes by most member of the National Assembly a proposal. It is that sport policy and operation are converted to private leading style from government management.
