EU의 스포츠법제 현황과 과제

The present status and task of European Union Sports Law

1970년대에서 80년대를 거치면서 유럽에서는 스포츠관련 법적 논의가 학문적인 접근으로 점화되었다. 점차 논의의 범위가 확대되고 심화되면서 실제로 스포츠사건과 관련하여 법원에서 합리적인 법적 근거를 찾게 되었다. 이에 따라 스포츠법의 영역이 매우 빠른 속도로 발전되기 시작하였다. 그러나 사실상 스포츠법이 태동하는 데에 있어서 매우 활기찬 동력이 되었던 것은 스포츠의 상업화 부분이었다. 스포츠의 상업화로 인하여 발생하는 여러 가지 법률적인 문제가 궁극적으로 스포츠의 법제화로 이끌어지게 되었다. 스포츠의 상업화와 법제화는 그러므로 평행하게 발전을 거듭해오게 되었다. 이런 발판을 기반으로 1990년대를 통해 스포츠법은 국제화의 길을 걷게 되었다. 특히나 유럽연합은 스포츠법의 국제화에 결정적 역할을 하였다. 스포츠와 EU 사이의 최초 관계는 스포츠에서의 상업적 발달에 의해 영향을 미치게 되었고, EU 스포츠법의 탄생은 정책적으로 추진된 것이 사실이다. 스포츠법의 적용과 관련하여 자주 등장하는 예 중의 하나가 보스만판결이다. 이 보스만 판결은 EU법과 함께 스포츠규칙의 양립성과 관련하여 구체적인 논쟁을 일으켰을 뿐만 아니라 유럽에서의 스포츠규범의 문화적인 배경이 변경되기도 하였다. 유럽미니헌법으로 불리는 리스본조약이 유럽연합 회원국으로부터 비준을 받게 된다면 이는 보스만판결에 나타난 다소간의 불협화음 이후에 스포츠가 유럽연합안에서의 법적 지위를 최종적으로 얻게 되는 계기가 될 것이다. 현재로서는 유럽연합의 조약이 가장 중요한 유럽스포츠법의 법원이다. 또한 유럽스포츠헌장, 스포츠프로토콜, 공정경쟁을 위한 스포츠윤리헌장, 유럽반도핑협정 및 유럽스포츠백서 등이 유럽스포츠법이라고 할 수 있다. 이 스포츠법규체계에 의하여 유럽은 유럽시민권자의 화합과 유럽의 단일시장의 성장시킨다는 목적 하에서 법적 분석을 확대하고 스포츠가 가지는 자체 배경을 적용할 것이다.

The increasing frequency of legal disputes involving sport throughout the 1970s and 1980s led to closer academic scrutiny of how law affects sport. As the volume of disputes increased further and as courts began to develop a line of legal reasoning concerning sport, so academics identified the emergence of a field of law-sports law. Slowly attention began to focus on the dynamics driving the birth of sports law. The Commercialisation and Juridification are therefore considered parallel developments. Throughout the 1990s sports law has internationalised. A frequently quoted example of this insensitive application of law to sport is the Bosman ruling. Bosman not only confronted specific issues concerning the compatibility of sports rules with EU law, it also altered the cultural context of sports regulation in Europe. If the European Conventions Draft Constitutional Treaty, also Lisbon Treaty is ratified by the Member States, sport will finally have achieved legal status within the EU after the divisive ruling in Bosman. At present is European Conventions Draft Constitutional Treaty the most important EU-Sports Law. Also the European Sport Charter, Sports Protocol, Ethik-Codex: Fair Play, European Anti-Doping Convention and EU-White Paper on Sport etc. are provided as EU-Sports Law. With the Sports Law-systems will EU extend their legal analysis and apply sporting contexts under the aim to harmonize European Citizen and to grow the EU s Single Market.
