체육진흥투표권 발행 사업 직영에 따른 법적 쟁점

이 연구는 국민체육진흥기금의 조성사업 중 국민체육진흥투표권 발행 사업에 대한 현황과 법적 관련 사항을 살펴봄으로써 국민체육진흥공단에서의 스포츠토토 직영에 따른 법적 정당성을 확보할 이론적 근거를 제공해 주는 데에 있다. 이와 같은 목적을 달성하기 위한 세부 내용으로 첫째, 체육진흥기금 조성사업에 대한 현황고찰을 통해 스포츠에서의 기여도를 재조명하고 둘째, 국가의 합법적인 사행사업으로서의 법적 근거를 살펴보고 셋째, 발행사업자의 직접 경영에 대한 법적인 당위성을 살펴보았다. 이 연구를 통하여 살펴본 결과는 다음과 같다. 체육진흥투표권, 경륜경정 투표권 등에 의해 조성되는 체육진흥기금은 2012년 기준 중앙정부 체육예산의 4.5배에 달하는 규모로서 우리나라 체육진흥에 일익을 담당하고 있다. 또한 체육진흥투표권 사업은「사행행위 등 규제 및 처벌 특별법」등에 저촉을 받지 않고 국가에서 법률로 인정하는 합법적인 사행사업의 일종으로서 긍정적, 부정적 효과가 상존하고 있다. 국민체육진흥기금이 목적사업을 위한 공익기금으로서 그 역할과 지위를 확보해야하며 이를 위한 국민들의 지지를 얻기 위해서는 기금에 대한 공공성과 건전성 및 투명성은 반드시 전제되어야 한다. 민간 위탁경영으로 유지해 오던 독점적인 체육진흥투표권 사업을 공익단체의 직접 경영체계로 전환하는 것은 공공성과 건전성 확보 측면에서 효과적인 방법으로 사료된다. 그러나 체육진흥투표권 발행 사업은 국민체육진흥법상 민간 수탁업자에게 위탁 운영토록 규정되어 있다. 그러므로 국민체육진흥공단에서 스포츠토토 사업을 합법적으로 직영하기 위해서는 국민체육진흥법 개정을 통하여 법적 정당성을 확보한 후에 시행되어야 할 것이다.

The purpose of this study was to provide the legal justification for the direct management at the Korea Sports Promotion Foundation through the examination of the legal issues of the Sports Toto. For the purpose of this study, First, look at the role and contribution of the Sports Promotion Fund in sports. Second, examined the legal basis of the Sports Toto s business. Third, examined the legal justification for the direct management at the Korea Sports Promotion Foundation. The results of this study are as follows:First, Sports Promotion Fund contributed a lot the development of sports in Korea. Second, Sports Toto s business legally allowed in our country. It is one of a speculative business. Third, after modified the National Sports Promotion Act, Korea Sports Promotion Foundation can be Sports Toto s management.
