Legal Study on the Dancesport Business in Korea

본 연구는 댄스스포츠의 건전한 발전을 위하여 국내 댄스스포츠 학원 운영에 대한 규제 현황 및 문제점을 재조명하고 이에 대한 개선방안을 제시하는 데에 그 목적이 있다. 이와 같은 연구목적을 달성하기 위하여 첫째, 현장에서 학원을 운영하고 있는 댄스스포츠 지도자들의 심층면담을 통하여 댄스스포츠 학원에 대한 행정규제 실태를 파악하고 둘째, 관련 법규고찰을 통하여 댄스스포츠업에 대한 법적 규제내용을 살펴보고 셋째, 댄스스포츠의 발전에 도움을 줄 수 있는 규제개선안을 제시토록 한다. 본 연구의 연구방법으로는 문헌연구와 심층면담법을 사용하였다. 국내에서 댄스스포츠는 무도학원업으로 분류된다. 체육시설의 설치 이용에 관한 법률에 규정되어 있는 무도학원업은 건축법, 풍속영업규제에 관한 법률, 청소년보호법, 학교보건법 등의 법률의 저촉을 받고 있다. 체시법상 무도학원업은 신고 체육시설업으로 규정하고 있으나 그 외 관련 법에서는 유흥업으로 규제하고 있어 이에 대한 개선이 요구된다. 본 연구에서는 개선방안으로서 볼룸댄스를 댄스스포츠로 용어를 변경하고 관련 법을 정비하는 안을 제시하였다. 관련 법 개정은 3가지로 고려할 수 있다. 첫째는 체시법상의 무도학원의 개념을 댄스스포츠로 한정하여 개정하는 방안이고 둘째는 무도학원업을 사교댄스업과 댄스스포츠학원으로 이원화하여 개정하는 방안이며, 셋째로 학원설립법상에 댄스스포츠업을 명문화하는 방안이다. 이 중에서 사교댄스에 대한 국내 인식, 법개정의 용이성 등을 고려해 볼 때 무도학원업을 사교댄스업과 댄스스포츠학원으로 이원화하여 개정하는 방안이 가장 실효성이 클 것으로 사료된다.

The purpose of the present study was to shed light on the current regulations and related problems in the operation of a dancesport academy in Korea and suggest new perspectives. In order to achieve the research purpose, a content analysis was utilized to broaden our understanding related legal regulations. Furthermore, in-depth interview with dancesport instructors was used to find out the reality that the instructors actually feels in their workplace. Lastly, the future directions for the regulations were discussed. Currently, the dancesport academy operation business is classified as one of the subcategories under the martial art academy operation business and defined in the physical education equipment installation and related law. The dancesport academy operation business is regulated by the architectural law, teenager protection law, traditional operation law, and school hygiene law. The opening of the dancesport academy operation business is only required to report a proper government office under the physical education equipment installation, but is defined as an entertainment business. In the present study, there are three modifications for the related law. First, the definition of the operation of a dancesport academy operation business should be placed under the physical education equipment installation and related law. Second, the martial art academy operation business can be separated as the social dance business and the dancesport academy business. Third, the dancesport operation business can be placed under the academy installation law. Among these suggested modifications, considering the easiness of regulation modification, the modification, in which separating the martial art operation business into the social dance operation business and the dancesport academy operation business seems can be the most appropriate.
