노인의 스포츠권 증진을 위한 사회복지법상 생활체육의 법제화 방안

A Study on Legalization of the Living sports in Social welfare law to enhance Sport rights of the Elderly people

본 논문은 급속히 고령화되어 가고 있는 우리 사회에 노인의 스포츠권 증진을 위한 중요한 대책으로서 노인의 생활체육 활성화 방안을 찾고자 마련되었다. 이를 위해 노인의 생활체육이 활발하게 진행되고 있는 사회복지영역의 관계법 전반을 면밀히 분석해 보고, 이를 통해 노인의 생활체육이 활성화될 수 있는 법제화 방안을 모색해 보고자 하였다. 노인의 스포츠권은 헌법 제10조를 근거로 보장이 되고, 이에 대한 구체적인 보장은 법률로 보장이 되고 있다. 그러나 노인의 생활체육과 관련된 사회복지법인 노인복지법, 저출산ㆍ고령사회기본법, 국민건강보험법, 노인장기요양보험법을 고찰해 본 결과, 대부분의 관련 법률이 노인 건강의 중요성은 선언적으로 명기하고 있지만 생활체육과 관련한 예방적인 차원의 노인 건강 유지를 위한 구체적인 활동 내용을 포함하고 있지 않았다. 이러한 현실을 극복하고 노인의 스포츠권을 증진시키기 위해서는 첫째, 헌법상 기본권으로서 노인의 스포츠권을 사회복지법 전반에 반영할 필요가 있으며, 둘째, 사회복지법상에 제기된 노인의 건강 유지 및 증진과 관련한 조항이 실천될 수 있도록 생활체육의 활성화 내용이 반영되어야 한다. 그리고 셋째, 생활체육이 사회보험 관련 사회복지법상에 보험방식으로 적용될 수 있도록 고려할 필요가 있으며, 넷째, 노인생활체육지도자의 자격 공인과 적절한 배치도 제도화 되어야 한다.

The purpose of this study is to find out ways to promote living sports for elderly people as key important measures to enhance their sport rights in this fast-aging society. This study closely analyzed all related acts in social welfare areas where living sports for elderly people are actively supported and find out ways to legalize their living sports. As a analysis result of all Social Welfare Laws related with living sports for elderly people such as Welfare of the Aged Act, Basic Act on Low Births and Aging Society, National Health Insurance Law, and The Act on Long Term Care Insurance for The Elderly, importance of health for elders are stated in most of the acts but activities to maintain their healthy life in relation to living sports were not specified. Four ways to recover this situation and enhance sport rights of the elderly people are,First, provisions on sport rights of the elderly people should be specified to all social welfare laws to promote their basic rights. Second, activation methods of the living sports should be specified in social welfare law so that current provisions to maintain and enhance health for elders would be performed. Third, there is need to consider to define living sports as one of the qualifications in social insurance in social welfare law
