중국 축구경기의 승부조작과 법적 규제에 관한 연구

A Study on Chinese Soccer Match-Fixing and Legal Restriction

최근 K리그에서 발생한 일련의 승부조작사건은 축구팬들에게 충격과 실망을 안겨준 바 있다. 그러나, 이번 사건을 통하여 축구계의 쇄신과 발전의 계기로 삼자는 자각의 목소리가 높은 것은 긍정적이라고 할 수 있을 것이다. 중국의 경우에는 2009년에 정부의 대대적인 축구 승부조작사건에 대한 조사가 있었으며 스포츠 도박의 근원을 찾아내어 단절하는데 상당한 성과를 이룬 바 있다. 즉, 중국은 중국 국내외의 전문 도박단들이 연루된 대부분의 승부조작 경기에 대한 증거를 찾아내고 관련자들을 사법적으로 처리하여 중국 축구계의 정화운동에 성공한 것이다. 중국 축구의 승부 조작 유형과 중국 정부의 대응을 살펴봄으로써 우리나라 축구계의 승부조작사건과 그 법적 처리에 대한 일정한 비교법적 방안을 도출해 낼 수 있을 것이다. 중국의 경우에는 뿌리 깊은 도박의 고리를 끊기 위하여 사법적 처리를 통하여 문제를 해결한 바 있으며, 형법에 따라 엄격하게 이를 처벌하였다. 그러나, 이러한 형법적 처벌 외에도 중국 축구계의 체질개선과 쇄신이 함께 따라야 한다는 자각의 목소리가 높다. 무엇보다도 중요한 것은 중국과 한국 모두 축구계의 오래된 악습을 없애고, 선수들의 지위와 대우를 강화하여 선수들이 도박이나 승부조작의 유혹에 빠지지 않게 배려해주도록 체제를 개선하여야 할 것이다.

A series of recent soccer match-fixing cases in the K-League have handed the shock and disappointment to the soccer fans. However, throughout this case, it might be positive that there has been a growing voice of reforming and cleaning the soccer sector. In the case of China, a major soccer match-fixing cases were investigated in 2009 by the Chinese government in an effort to find and disconnect the source of sports betting, achieving significant results. In other words, China found evidences for match-fixing matches involving a professional gamblers in China and outside China and indicted most of the people related to match-fixing games to purify the Chinese soccer sector. It will be possible to derive comparative measures in the law between China and Korea by looking at Chinese soccer match-fixing type, and the Chinese government s response. On the top of that, this study will give implications to Korean soccer match-fixing case and its legal treatment. In the case of China, judicial process through the bars, and criminal penalties was strictly implemented in order to break the cycle of the deep-rooted sports gambling. However, in addition to those penalties, there is opinion of requiring reformation of the basic attitude of soccer sector in China. Most importantly, both China and South Korea will have to try to improve their system by eliminating football s old bad habits and strengthening the players position lest to fall into the temptation of gambling and match-fixing.
