스포츠 분쟁해결에 관한 연구

Study on Dispute Resolution in Sports

현재 스포츠와 관련된 분쟁은 여러 가지 형태로 발생하고 있다. 또한 앞으로 스포츠 관계자들의 권리의식의 향상에 따라 분쟁의 건수도 점차로 확대될 가능성이 높다고 할 것이다. 따라서 스포츠분쟁이 법원에서 다투어질 사안도 점차로 확대될 것으로 생각된다. 한편으로는 다양한 형태의 스포츠 분쟁사건은 보다 신속하고 효율적인 법률적 해결방안을 요구하고 있다. 이에 따라 여러 형태의 재판 외의 분쟁해결방안을 마련하고 있으며, 이러한 해결방안들 가운데 하나로 한국스포츠중재위원회((Korea Sports Arbitration Committee)의 역할이 많은 관심을 받고 있다. 한국스포츠중재위원회는 스포츠경기자와 스포츠경기단체 등의 분쟁을 해결하기 위해 설립되었다. 본고는 우선적으로 스포츠를 둘러싸고 발생하는 분쟁의 유형과 특징을 정리하여 본다. 아울러서 분쟁의 해결방안에 대해 검토한 후, 한국스포츠중재위원회의 설립에 많은 영향을 준 일본의 스포츠중재기구(Japan Sports Arbitration Agency)에 대하여도 비교법적 관점에서 살펴보고자 한다.

Currently disputes related to sports arise in various ways. Moreover, as the awareness of the rights of the people in the field of sports grows the chances of increase in the number of disputes increases. Therefore, the sports disputes which will be dealt by courts will increase. On the other hand, there are demands for fast and efficient legal resolutions for diverse sports disputes. Thus, alternative dispute resolutions other than the court are being prepared, and the Korea Sports Arbitration Committee is under the spot light within the resolutions. The Korea Sports Arbitration Committee has been established for dispute resolution between athletes and the clubs or alike. This study will first arrange the characteristics and patterns of the disputes in sports. Then will analyze the dispute resolutions schemes, and review Japan Sports Arbitration Agency which influenced the establishment of the Korea Sports Arbitration Committee through comparative law analysis.
