한국헌법에 있어서의 스포츠조항의 위치

스포츠와 헌법의 관계에 관한 선행 연구에 의하면, 스포츠에 관한 국민의 권리를 인정한다 하더라도 이를 기본권으로 구성하여 기본권에 관한 장에 위치시킬 것인지 아니면 국가목표 규정으로 보아서 헌법의 총강 부분에 놓을 것인지의 여하는 계속적인 논의의 과정에 있다. 이번 학회에서 필자가 좌장으로 참여한 세션의 발표 논문을 보면, 일본국 교수는 기본권 규정으로서보다는 국가목표규정으로 보아야 함을 역설하고 있다. 중국 학자는 헌법에 열거되지 아니한 권리로서의 기본권으로 보는 듯하다. 한국의 발표 논문은 기본권으로 전제하고 있다. 스포츠와 기본권 또는 스포츠와 국가목표 등의 논의는 각 시대마다의 스포츠의 발전에 따르는 그 시대에 적합한 무엇을 창출하고자 하는 항상적인 경신의 과정에서 바라보아야 한다. 스포츠에 대한 기본권적 판단 내지 문화국가적 접근은 일반적 세계관 내지는 법적 가치 관념의 표현으로서 구체화 되는 논의이어야 한다. 그러기에 스포츠 조항을 헌법에 규정한다면 이를 기본권 규정으로서보다는 국가목표규정으로 보아서 국가의 정치적인 방침으로서 헌법에 규정하는 것이 적합하다. 이는 국가권력에 제한을 둠과 동시에 국가의 존재를 정당화 한다고 하는 이중의 역할을 수행한다.

According to the preceding study regarding sports and the constitution , there is on a process of a continuous discussion. whether it is to let you locate in a chapter regarding a fundamental rights or a ‘general provisions part. If you watch an announcement paper of the session that the writer participated in to moderator in this learned societies, the professor of Japanese saw as national goal regulations rather than the fundamental rights. Chinese scholar seems to see fundamental rights which is not enumerated in the constitution. A Korean announcement paper is premising to basis rights. My definition such as sports and a fundamental rights or sports and a national goal etc shall be close in processes of the newly development which will create what which is suitable in the times to obey in development of sports of every each times. Fundamental judgment regarding sports or approach national culture shall be a discussion becoming embodiment as a general world view or expressions of a legal value general idea. It is suitable you see to national goal regulations that you saw as fundamental rights as you are so if you define sports clause in the constitution, and to define in the constitution as national political courses. This means the dual role that justify the existence of nation, and at the same time to leave restriction to national power.
