이종격투기 사망사건에 대한 형법적 검토

이 글에서는 이종격투기 경기에서 발생한 사망사건에 대하여 형법적 책임문제를 검토하였다. 이 문제의 핵심은 이 사건이 형법상 업무상 과실치사죄에 해당되는지에 있으며 경기주최자, 심판, 링닥터, 링세컨, 선수 등 경기에 관련된 자들이 법규범에서 요구하고 있는 주의의무를 성실하게 이행하였는지의 여부가 중요한 판단의 대상이 된다. 관련자 각자가 자신이 수행하는 업무범위에서 사망이라는 결과의 발생가능성을 예견하여 선수가 사망하지 않도록 해당 분야의 평균적인 종사자가 갖고 있는 정도의 주의를 기울여서 적절한 조치를 취한 경우가 아니라면 업무상 과실이 인정될 수밖에 없다. 이종격투기 경기는 특성상 선수의 사망이나 부상에 대한 위험성이 다른 어떤 경기보다 높기 때문에 경기 관련자들에게는 매우 높은 정도의 주의의무가 부여되어 있다. 따라서 경기 관련자들에게는 사망이나 부상의 위험으로부터 선수를 보호하기 위하여 각자 자신이 수행하는 업무에 대하여 고도의 주의를 기울여야 한다.

Since 2003 mixed martial arts(MMA) gained international exposure and widespread publicity in Korea. Criminal responsibility for accidential death which occurs in MMA was reserched in this paper. The Point of this reserch is ob this case can correspond to the negligent homicide at business or not. Ob the person like a chief manager of company which hold mma game, referee, ring doctor, ring second, player has performed his duty of care which was demand by the law is key issue. If they have taken any proper and prompt action to prevent player from danger of death when they foresee accidential death negligence at business have to be recognized. Beacause mma is more dangerous than any sport, severe duty of care is provided for Officials of mma. Therefore must Officials of mma give attention to their business.
