학교의 스포츠와 국가배상책임

Sports in School and the National Government s Indemnity

학교의 안전사고는 체육수업시간과 과외활동 등 교실 밖에서 많이 발생하고 있다. 이는 체험 및 활동중심의 교육에 대한 수요증대가 안전사고 증가에 많은 영향을 미치기 때문인 것으로 분석되고 있다. 따라서 학교의 안전사고는 스포츠 시설 및 체육활동과 관계가 매우 깊다고 할 수 있다. 본고는 스포츠활동으로 인한 학생사고에 대해 국가의 배상책임에 관한 법리에 대하여 검토한다. 특히 우리의 국가배상법에 많은 영향을 미친 일본의 법제 및 법리를 비교법적 관점에서 살펴보고자 한다. 우선 스포츠와 관련된 학교의 안전사고에 대한 우리나라(한국) 및 일본 양국의 판례의 동향을 검토하여 국가배상책임의 법리적용실태와 양국의 사법부의 태도를 비교하여 보고자 한다.

School accident happen frequently outside of the classrooms such as the gym class or extra curriculum activities. Growing number of school accidents are traced to the increased emphasis in experience and activity centered education. Therefore, school accidents are closely related to the gym facilities and the athletic activities. This thesis examines the legal theories regarding the national government s indemnity of student s damages caused by school athletic activities. Further, this thesis will analyze the japanese laws and legal theories that has influenced the korean law of governmental indemnity through comparative law viewpoint. Foremost, it will examine the recent case laws of Korea and Japan which deals with sports related school accidents in order to compare the differences of applying the legal doctrine of governmental indemnity and the stance of the department of justice of both countries.
