프로야구 선수계약에서의 불공정성 문제

Unfairness Issues on the Contract for Professional Baseball Players

사회적·경제적 발전에 따라 국민들의 여가에 대한 욕구가 증가하면서 스포츠에 대한 관심이 갈수록 높아지고 있다. 특히 프로야구는 많은 국민들의 사랑을 받고 있는 인기경기 중 하나이다. 국내 프로야구를 관할하고 있는 한국야구위원회는 리그의 운영전반에 필요한 자금을 조달하고 규칙을 제정하는 등에 있어 독점적인 지위를 갖고 있으며, 회원으로는 리그를 구성하는 8개 구단을 거느리고 있다. 각 구단이 개별 선수와 선수계약을 체결함에 있어서는 야구규약을 기초로 하는 통일선수계약서가 사용된다. 프로야구 리그의 法源인 야구규약과 그에 따른 통일계약서는 상호 연결되어 있는 바, 선수계약과 야규규약의 법적 성질 및 야구규약이 선수계약으로 그 내용이 편입되는지 여부를 규명하는 것이 필요하다. 그리고 이들은 그 형식면에서 선수의 참여가 배제된 채 일방적으로 작성됨에 따라 선수의 이익을 고려하는 데 있어 부족함이 많은 게 사실이다. 따라서 선수의 권리보호를 보다 효과적으로 실현시키기 위하여 통일계약서의 내용에 대한 법률상의 통제가 이루어져야 할 것이다. 이에 관하여는 민법과 독점규제법 및 약관규제법 등이 선수계약서 내용의 불공정성을 판단하는 기준을 제시하고 있다고 할 수 있다. 그러한 불공정성의 판단 대상이 되는 구체적인 내용으로는 신인선수지명행위, 1년 계약제, 이적선택자유의 제한, 선수가 관여하지 않는 중재합의, 대외활동금지, 초상권과 저작권의 제한적 사용, 대리인 제한 등을 들 수 있다.

As the social economy in Korea has developed and people are more willing to enjoy leisures, they are more and more interested in sports. Professional baseball league is one of the most popular games. The Korea Baseball Organization(KBO) manages the eight teams of the league and assists the members for their financial resources. The KBO holds the exclusive status in establishing or enacting the rules of the national league. Players Contract is conducted when a player agrees with the KBO Rules, the Uniform Players Contract. The Uniform Players Contract holds the statutes and agreements which form the legal source of baseball league. Therefore, I examined whether the terms of the Uniform Players Contract is incorporated with the player s contract. The examination forced this study to analyze the contract that because it was established with the exclusion of the players. Therefore, the concern in this study is to find out the attributes of unfairness of the contract in the aspect of players benefit. For the protection of player s right, the provision of terms should be inserted in the regulation of the Uniform Players Contract. I insist that the criterion of the judgement of unfairness is clearly stated in other regulations such as the Civil Act, the Monopoly Regulation and Fair Trade Act, and the Regulation of Standardized Contracts Act. Furthermore, on the subject of the judgement of unfairness, there are the restraints on the Trading and Draft such as a single term, the use of personal publicity- and copyright, agent, and the arbitration agreement though they are enacted with the exclusion of the player.
