해양 레저스포츠의 안전관리 규제에 관한 연구

A study on the safety regulation in the marine leisure sports

본 연구는 보다 안전한 해양 레저스포츠 활동을 영위할 수 있도록 법제도적인 문제점을 도출하여 개선방향을 제시하는데 그 목적이 있다. 이를 위하여 우리나라 해양 레저스포츠의 현황을 살펴보고, 해수욕장, 낚시, 수상스포츠 활동을 규제하고 있는 관련법들을 고찰한 결과는 다음과 같다.1. 우리나라는 해수욕, 낚시, 수상스포츠 등 국민들의 대표적인 해양 레저스포츠 활동을 규율하는 개별법규는 마련되어 있으나 해양 레저스포츠 활동을 종합 관리할 수 있는 법률은 제정되어 있지 않았다. 또한 해양 레저스포츠 관련 활동을 규제하는 내용이 여러 법규에 분산됨으로써 해양 레저스포츠의 활성화 및 안전한 레저문화 정착에 도움을 줄 수 있는 법적 지원체계가 다소 미흡한 것으로 나타났다. 2. 우리나라의 대표적인 연안친수 공간인 해수욕장의 경우 다소 법적 기반이 미흡한 해양수산부의 예규와 지방자치 조례로 운영 관리되고 있다는 문제점을 보완하기 위해 입법 예고된 해수욕장 관리법안의 조속한 제정과 시행을 위한 관련기관의 노력이 요구된다. 3. 법규상 해수욕장에서의 안전구난체계의 구축은 지방자치 단체장이, 해상에서의 수난구호는 해양경찰서장이 담당하도록 장소에 따라 분리되어 있기 때문에 안전관리 업무의 전문화와 효율성을 위하여 일원화될 수 있도록 법제도를 정비해야 하며, 현재 운영되고 있는 시민 수상구조대의 자원봉사자 체계를 점차 유급화 또는 정규직으로 전환토록 개선해야 할 필요가 있다.4. 국내 낚시어선업으로 등록된 어선의 경우 약 75%가 5t 미만인 점을 고려할 때 안전강화를 위해서 이용객들의 구명조끼 의무착용을 5t 미만인 어선까지 확대 시행할 필요가 있다.5. 수상 레저스포츠의 안전을 총괄적으로 규제하는 수상레저안전법에 스킨스쿠버 다이빙의 종목에 대한 규제가 마련되어 있지 않아 이에 대한 법정비가 시급하다.6. 수상 레저스포츠에서 발생한 사고는 운항부주의와 같은 인재성 사고가 대부분이었고, 법규 위반사례 또한 안전장비 미착용 등과 같은 안전 불감증에 의한 위반이기 때문에 안전의식이 정착될 수 있도록 지속적인 지도감독과 함께 이에 대한 규제안을 강화할 필요가 있다.

This study reviews safety of marine leisure sports regulation for safer marine leisure sports activity by suggesting betterment through considering law and regulation. The results of this study were as follows. 1. Korea has individual regulation for marine exercise such as sea swimming, sea fishing, and leisure sports in water, but lacking the law for whole management. And, aforementioned regulations are dispersed, which means lack of lawful support for betterment of marine exercise. 2. Korea s representative coastal hydrophilic space - beach - is governed by the Ministry of Maritime Affairs and Fisheries rules and local guidelines, and it is such a lawful fragility, so there should be bureau s support for legislation of Guidelines for beach facility and management. 3. By law, rescuing system at beach is built by local government head, rescuing in the sea is under authority of sea police office s head, so conversion should be to unify for rescuing action for efficiency and specialization. Also life guard is maintained by voluntary service of civilian, but they should be paid, or hired formally. 4. Of all the registered fishing boat, 75% is under 5t, for the sake of the security of fisherman, mandatory wearing of life jacket should be expanded to boat under 5t. 5. By the water leisure safety law, there is no regulation on skin-scuba diving, so regulation should be made. 6. Accidents of marine leisure sports is mostly man-made disaster, and violation of regulation was due to insensitivity to safety, so strong supervision and supplement for the regulation should be followed.
