Sports Accident and the Reparation by the State Liability

본 논문은 일본의 학교스포츠의 사례를 소재로 하여 스포츠사고와 국가배상책임에 관하여 살펴보는 것이다. 그 결과 일본에서는 학교스포츠는 비권력적인 행정작용이지만 일본의 국가배상법 제1조가 적용된다는 점을 알았다. 그리고 무엇보다 중요한 점은 스포츠사고에 일본 국가배상법 제1조가 적용될 경우에 배상책임을 인정하기 위한 근거로 교사의 ｢안전배려의무｣가 민사관계로부터 차용되어 이용되고 있다는 점이다. 이것은 학교스포츠사고의 특색, 즉 ｢공권력의 행사｣가 직접적인 가해행위가 되어 발생한 직접 타격형의 예는 드물고 대부분은 다른 원인에 의해서 발생한 피해를 방지하지 않은 위험관리책임형(型) 내지는 부작위적 불법행위의 유형이 대부분이라는 점에서 유래한다고 할 수 있다. 종래의 판례는 이 이론적 근거에 대하여 소극적이었지만 최근에는 거의 모든 판례가 교사의 안전배려의무를 키워드로 하여 배상의 유무를 판단하고 있다고 해도 지나친 말은 아니다. 그러나 이 교사의 안전배려의무는 친권자의 감독의무처럼 학생의 모든 생활관계에 걸치는 것이 아니라 학교에서의 교육활동 및 이와 밀접한 관계에 있는 생활관계에 한 하여, 그 의무의 내용･정도, 교육활동의 성질(위험의 유무), 학교생활의 때와 장소, 학생의 연령, 지능, 신체의 발육상황, 사고발생의 구체적 상황 등에 따라 달라질 수 있다는 점을 알았다. 따라서 앞으로의 과제는 이미 상당한 이론을 전개하고 있는 일본에서의 사례를 참고삼아서 우리나라에서의 판례의 축적과 이론의 정립을 꾀해가야 할 것이다.

It can be learned that the article 1 of the Japanese national compensation law isapplied to a school sports accident if it is a non-power administrative action. And wealso know that they borrow the concept, “the teacher′s obligation to consider thechild′s safety” from the civil law to recognize the reparation by the state liability. Itcomes from the fact that the most of school sports accident is not the type to bedirectly harmful to child but to neglect to prevent the accident in advance. In thepast the Japanese Court was not so positive to accept the theory mentioned above,but these days it decides if the state compensates or not according to the concept,“the teacher′s obligation to consider the child′s safety”.But “the teacher′s obligation to consider the child′s safety” is limited to theschool activity and the closely related one to it, contrary to that of the parent′s anddiffers according to the content and degree of the obligation, the property, time andplace of the school activity, and the age and the intelligence of the child, etc.Accordingly in Korea we strive to construct the theory and to accumulate the casereferring to those of Japanese.
