SITUATION, TREND AND LEGAL POLICY OF SPORTS LAW IN INDIA

The ‘All India Council of Sports’ was formed by the Union Minister of Education in the Year 1954 for the purpose of having a body of persons interested in games & Sports available to the Government to advice them on matters relating to Sports. In the year 1958, it was recommended to reconstitute the AICS consisting of 11 to 15 persons, who have knowledge, standing and experience of sports and their administration. After a gap of approximately 40 years the Govt. of India has once again set up ‘All India Council of Sports’. The Gazette Notification was issued on 16th July 2002. The inaugural meeting of AICS was held under the Chairmanship of the Prime Minister of India in his residence on 23rd November 2002. An ‘All India Sports Congress’ was convened on 28th August 2003 and Prime Minister of India had inaugurated the Congress at Vigyan Bhawan. Beside several recommendations repeatedly enumerated in National Sports Policy. The Congress made a recommendation to the Union Minister of Law, Justice and Company Affairs to institute, ‘All India Sports Services Cadre’ for Sports Administrators, on the suggestions of Prof. (Dr.) Amaresh Kumar, Secretary General, Sports Law India, presenting his paper, ‘Indian Sports National Prestige have lost’. The Supreme court of India in the case of V.C.Shukla Vs. Tamil Nadu Olympic Association & others, 1991 AIR SCW 774; had also recommended the same. The Sports Law India is still making an effort for the establishment of a Courts of Sports Arbitration in India in the principles and line of International Court for Sports Arbitration.
