A Study on Legal Policy in the Bicycle and Boat Racing Act

최근 손봉숙의원등 일부 국회의원이 중심이 되어 경륜경정법 개정법률안을 국회에 제출하였다. 그 주된 내용은 장외매장의 설치기준을 신설함과 아울러 장외매장의 허가에 따르는 출입횟수 제한의 근거를 마련하는 등 장외매장의 설치허가절차를 강화하고, 승자투표권의 구매금액의 상한제를 두고 그 준수여부를 신원확인 절차를 거치도록 하고 이를 위반하였을 경우에 제재수단을 두는 것을 내용으로 하고 있다. 우선 여기에서는 경륜경정을 사행산업이라는 관점으로만 보아서는 문제해결이 되지 않고 사행적 측면도 있지만, 경륜경정법의 목적에서도 명기하고 있듯이 국민의 여가선용을 도모하는 것이므로 경륜경정을 내기 스포츠의 일종이라는 관점에서 접근하였다. 장외매장의 축소가 야기하는 문제는 장외매장을 통한 수익의 상당부분이 체육기금에 충당되므로 장외매장의 축소는 체육재정에 심각한 문제를 야기하고, 장외매장에 대한 유효기간이 경과한 후에 갱신하지 않을 경우에 기득의 영업권을 침해 할 우려가 있으며, ID 카드를 통하여 일일구매 상한액에 대하여 통제하려는 것은 프라이버시 내지 사생활의 비밀을 침해할 우려가 있으며, 다른 불법! 도박이나 해외원정도박 등으로 옮겨가는 부작용이 예견된다. 따라서 체육재정의 재원확보방안을 마련하지 아니한 채 장외매장의 축소와 투표권상한제 등을 신설하는 것을 내용으로 하는 개정법률안은 헌법상 보장되고 있는 기본권의 침해 우려가 있으므로 입법에 있어 신중을 기할 필요가 있다.

This article present a study on the legal policy in the Bicycle and Boat Racing Act In recent years, some parliaments including parliament of Bong-Suk Son submitted a revised Bicycle and Boat Racing Act to the National Assembly. The major issues of this Act are to newly build the foundation rule for an over-the-counter market and establish a base of the limitation of the number of coming in and out to the over-the-counter market in order to make strengthening the permission process of over-the-counter markets. In addition, this Act includes the least upper bound of purchasing amounts and some sanctions according to the violation of the rule through certain verification processes of the market. It is not reasonable that such bicycle and boat racing is only a type of speculative businesses to solve the problem existed in these issues. Although, such bicycle and boat racing presents certain speculative aspects, this study approaches to this business as a type of betting sports based on the fact that the objective of Bicycle and Boat Racing Act is to promote people s recreational activities. Because the problem caused by the reduction of over-the-counter markets can be complemented as the athletic foundation from the benefit of over-the-counter markets, the reduction of over-the-counter markets can cause a serious problem in the athletic finance and violate the vested right of business in the case of the fact that the renewal of the term of validity for over-the-counter markets is not applied. In addition, a certain control of the least upper bound of daily purchasing amounts using an ID card will cause the violation of the privacy and some side effects, such as other illegal gambles or overseas gambles. Thus, it is necessary to present certain circumspections in the enactment of legislation due to the fact that the revised Bicycle and Boat Racing Act, which includes the reduction of over-the-counter markets and least upper bound of votes, may violate the basic human rights in the constitutional law without any preparations of the athletic finances.
