미국의 학교 내 장애학생 의료적 지원 체제 형성과정의 특징

Characteristics of Medical Support System Formation for Students with Special Health Care Needs in U.S.

일부 중도중복장애 또는 건강장애 학생은 통합교육을 받기 위해 학교 내에서 전문적인 건강관리 절차가 필요하다. 그러나 한국에서는 학교 내 의료적 지원에 관한 제도적 기반이 미비한 실정이다. 이에 본 연구는 판례, 선행연구, 관련 법률 조항을 중심으로 미국의 학교 내 장애학생을 위한 의료적 지원의 제도적 기반이 형성된 과정과 그 특징을 알아보고, 이를 한국의 사례와 비교하였다. 미국의 의료적 지원체제 형성과정의 특징은 다음과 같다. 첫째, 미국은 영미법 전통에 따라 법원 판결을 중심으로 장애학생 의료적 지원의 책임 주체가 결정되었다. 각 학교는 이에 따라 자율적으로 구체적인 지원체제를 마련하였다. 많은 학교에서 기존의 학교 간호사 제도를 통해 장애학생의 의료적 지원을 실시하였다. 둘째, 당사자들이 능동적이고 주체적으로 항소하여 의료적 지원을 받을 권리를 쟁취했다. 이와 달리 한국은 관련 판례를 찾아보기 어렵고, 학교 간호사 제도가 정착되지 않았으며, 소송 등을 통한 권리 투장의 경향도 적다. 그러나 이는 각 관련 주체의 개인적인 차이보다는 대륙법 전통과 영미법 전통에서 판례가 갖는 위상의 차이, 이의제기에 관한 적법절차 마련 여부의 차이 등 구조적인 맥락에서 이해해야 한다.

For inclusion, some students with severe and multiple disability or other health impairment need to receive special health care procedure in school. However, Korea lack medical support system at school for them. In this situation, this study investigated the formation of medical system formation in U.S. and the characteristics, and campared with case of Korea. As a result of reviewing legal provisions and precedents, and related prior studies, the characteristics of the U.S. medical support system formation are as follows. First, in the U.S., the Anglo-American legal system, the responsible personnel for medical support was determined around court decisions. After court decisions, each school has autonomously established a specific support system. Many schools have provided medical support for students through the school nurse system. Second, students and their family struggle for the right to receive medical support actively and independently. However, it is difficult to find related precedents in Korea, the school nurse system has not been established, and there is little tendency to struggle for rights through lawsuits. This should be understood in a structural context, such as differences in status of precedents in civil-law system and Anglo-American legal system, and differences in whether due process for objection are prepared.
