본 연구는 일상생활영역을 중심으로 구금시설 내 장애인 수용자에 대한 정당한 편의제공 실태를 분석하고 개선에 필요한 주요 과제를 도출하는 것을 목적으로 진행하였다. 이를 위해 본 연구에서는 먼저 구금시설 장애인 수용자 관련 국내와 해외의 법과 제도, 그리고 사례를 분석하였다. 그리고 구금시설의 장애인 수용자에 대한 설문조사를 통해 현재 제공받고 있는 편의의 내용과 실태를 분석하였으며, 이와 함께 장애인 수용자와 교도관과의 심층인터뷰를 통해 정당한 편의제공 현황을 살펴보았다. 연구결과 공간과 편의시설의 부족, 그리고 개별적인 지원의 부족 및 장애인 수용자의 생활상의 어려움이 제시되었으며, 장애유형별 맞춤형 편의제공의 필요성이 확인되었다. 또한 구금시설 장애인 수용자에 대한 처우와 정당한 편의제공에 관한 세부지침의 필요성, 그리고 장애인 수용자에 대한 통계분석의 필요성 등이 제시되었다.
The purpose of this study was to analyze the actual conditions of providing reasonable accommodations to inmates with disabilities in detention facilities, focusing on the areas of daily life, and to derive major tasks for improvement. To this end, this study first analyzed in-depth domestic and foreign laws and systems and overseas cases related to inmates with disabilities in detention facilities. In addition, through a survey on inmates with disabilities, the contents and actual conditions of convenience currently provided were analyzed, along with individual interviews with inmates with disabilities and correctional officers to examine the status of legitimate convenience provision. As a result of the study, the lack of space and convenience facilities, the lack of individual support, and the difficulties in life of the inmates with disabilities were suggested, and the need for customized convenience for each type of disabilities was confirmed. In addition, the necessity of detailed guidelines on the treatment of inmates with disabilities in prisons and the provision of reasonable accommodations, and the necessity of statistical analysis on inmates with disabilities were presented.
