심리상담 법안에 나타난 심리상담 정체성 탐색

A Study on Psychological Counseling Identity appeared in Proposed Legislation on Psychological Counseling

이 연구는 21대 국회에서 발의된 2개의 심리상담법안에 나타난 심리상담의 정체성을 탐색하는데 목적이 있다. 이를 위해 각 법안에 나타난 심리상담의 정의, 주체, 대상, 심리상담사의 직무를 살펴보고 이를 기존의 심리상담 문헌과 정신건강의학, 사회복지, 임상심리 분야의 법률, 국가직무능력표준(NCS) 등과 비교분석하였다. 연구결과 각 법안은 심리상담의 정의 부분에서는 심리상담의 대상에 대한 정의에서 심리상담의 정체성이 잘 드러났고, 심리상담의 목적과 방법에서는 심리상담 NCS와 유사하게 표현하는 것으로 나타났다. 심리상담의 주체 부분에서는 심리상담사 자격, 자격응시조건, 국가시험, 심리상담사가 아닌 자에 대한 금지 사항 등을 통해 심리상담의 정체성이 표현되었으나, 향후 시행령 제정 단계에서 학과목, 실습, 수련 등에 대한 구체적인 기준 설정이 필요한 것으로 나타났다. 심리상담의 대상과 심리상담사의 직무 영역에서는 관련 직역과 차별화된 내용을 제시하여 심리상담의 정체성을 잘 드러내고 있는 것으로 나타났다. 연구 결과를 바탕으로 심리상담 법제화의 의미와 향후 법제화 과정에서 고려할 사항에 대해 논의하였다.

The purpose of this study is to examine the identity of psychological counseling expressed in the two psychological counseling laws proposed in the 21st National Assembly. To this end, the definition, subject, object, and work of psychological counselors in each bill were reviewed, and this was compared and analyzed with the existing psychological counseling literature, the laws in the fields of mental health care, social welfare, and clinical psychology, and the National Competency Standards (NCS). As a result of the study, each bill clearly revealed the identity of psychological counseling in the definition of the subject of psychological counseling, in terms of the purpose and method of psychological counseling, it was found to be expressed similarly to the psychological counseling NCS. In the subject part of psychological counseling, the identity of psychological counseling was expressed through the qualifications of a psychological counselor, qualification test conditions, national examinations, and prohibitions against persons who are not psychological counselors. But it was found that it was necessary to set specific standards for subjects, practice, training, etc. at the stage of enactment of the enforcement ordinance in the future. In the area of ​​the subject and work of psychological counselors, it was found that the identity of psychological counseling was well revealed by presenting content differentiated from other human helping areas. Based on the results of the study, the implications of legalization of psychological counseling and considerations for future legalization were discussed.
