스포츠 팀닥터의 의료법상의 문제

A Study on the Various Problems of Sports Team Doctors in Applying Medical Service Act

스포츠 선수가 자신의 역량을 펼치면서 스포츠 활동을 하는 데는 코치, 감독 등 경기 지도자의 역할 외에도 흔히 트레이너나 팀닥터라고 불리는 고도의 의학적 전문지식과 경험을 지닌 의료진들의 관리와 감독 역시도 중요하다. 그러나 우리나라의 현실은 스포츠팀 내의 의무스태프들을 관행적으로 팀닥터라고 무분별하게 호칭하고 있으며, 팀닥터에 관하여는 별다른 정의 및 자격요건에 관한 규정도 존재하지 않고, 이에 관한 충분한 연구나 논의조차 없다. 이에 따라 무자격 팀닥터들이 의료행위를 하거나 스포츠계에서 불법행위를 자행하는 경우도 발생하고 있으며, 심지어 의료인이 팀닥터 활동을 하는 과정에서도 현행 의료법에 저촉될 소지가 다분한 것이 사실이다. 본고에서는 영미에서의 스포츠 팀닥터의 정의와 자격 요건 및 운용례를 검토하였다. 거기에 우리나라의 스포츠 연맹 혹은 협회, 프로구단 등의 정관, 규정, 운영 규정, 규칙, 각종 계약서상에 산재하는 내용 안에서 스포츠 팀닥터의 개념표지와 자격 요건 등을 추출해 보았다. 위와 같은 검토를 통하여 향후 우리나라 스포츠 팀 내에서 팀닥터의 정의 및 자격요건을 정하는데 참조할 수 있는 점들을 찾아보고자 한다. 또한 스포츠 팀닥터가 활동하면서 의료행위를 수행하는 경우, 현행 의료법의 적용과 해석에 있어서 발생 가능한 문제점 등을 상정하여 스포츠 활동의 특수성과 전문성과의 조화를 이루면서도 법적 문제를 해결해 나갈 수 있는 방안도 연구할 필요가 있음을 밝히고자 한다.

In performing players’ ability potentially for sports activities, it is important to get management and supervision from medical staff, often called trainers or team doctors, with high medical expertise and experience besides the role of team leaders such as managers and coaches. In actual practices of the Korean sports society, however, medical staffs in sports teams are called 'team doctors' indiscriminately and repeatedly. There are no provisions for the definition and qualification requirements of team doctors and there is no sufficient research or discussion. Accordingly, unqualified team doctors conduct medical activities occasionally or commit illegal activities and even in the process of working as a team doctor by a qualified medical practitioner, there is a lot of possibilities to violate the current Medical Service Act. In this paper, I describe the definition, qualification requirements, and operation examples of sports team doctors in the United States. In addition, I extract the concept and qualification requirements of the sports team doctors from articles, rules, regulations, and contracts of the Korean sports society and professional teams in Korea. Through such a review, I try to find important points which can be referred to in determining the definition and qualification requirements of team doctors in sports teams. I also insist that it is necessary to solve various legal problems under the harmonization of distinctiveness and expertise of sports activities by introducing possible issues during the application and interpretation of the Medical Service Act.
