비자의입원 정신장애인을 위한 절차보조서비스 과정에 대한 연구

A study on the procedural assistance service process for non-voluntary inpatients with psychiatric disabilities

비자의입원 정신장애인의 절차적 권리보장을 위해 시범사업으로 시작된 절차보조서비스가 본사업으로 전환되었다. 제2차 국가정신건강기본계획에서는 절차보조서비스를 17개 광역 지자체로 확대하는 것을 목표로 제시하고 있으며, 법제화를 위한 노력도 활발하게 이루어지고 있다. 이에 본 연구는 그동안 시범사업으로 이루어졌던 절차보조서비스의 과정을 심층적으로 분석함으로써 향후 제도화를 위한 실천적 제언을 도출하고자 하였다. 이를 위해 일개 절차보조사업단의 실무자 8명을 대상으로 인터뷰를 실시하였다. 분석결과 절차보조서비스는 ‘과정으로서 신뢰 쌓아가기’, ‘이용자가 이해할 수 있도록 정보제공’, ‘이용자의 입장에서 의사결정지원’, ‘제도적인 권리 신청이 가능하도록 지원’, ‘치료에 주도적으로 참여할 수 있도록 지원’, ‘가족과의 효과적인 소통 지원’, ‘지역사회 대안 마련을 통한 퇴원 지원’, ‘권리옹호’, ‘현실적인 제약들’로 나타났다. 분석 결과를 통해 절차보조서비스의 핵심 요소가 ‘지원의사결정’, ‘과정’, ‘소통’이며, 이를 위해 절차보조서비스의 역할 규정, 절차보조인의 역량강화, 동료지원가의 역할 확대, 지원의사결정 교육 활성화, 입원 과정에서의 권리보장, 인권중심의 치료환경 개선, 법제화와 확산을 제언하였다.

The procedural assistance service, which started as a pilot project to protect the procedural rights of people with psychiatric disabilities who are involuntarily hospitalized, was converted into a main project. The 2nd National Mental Health Plan proposed to expand procedural assistance services to 17 municipal governments, and efforts to legislate are actively being made. Therefore, this study tried to derive practical suggestions by in-depth analysis of the process of procedural assistance service. To this ends, interviews were conducted with 8 staff of one procedural assistance project group. As a result of the analysis, procedural assistance services were 'building trust as a process', 'providing information for users to understand', 'supporting decision-making based on the user's view', 'supporting institutional process', 'Supporting for taking initiative in treatment', 'Supporting for effective communication with family', 'Supporting for discharge through community alternatives', 'Advocates', and 'Practical constraints' were found. Through the analysis results, the core elements of procedural assistance services are 'supported decision-making', 'process', and 'communication'. Identifying the role of procedural assistance service, empowerment of assistants, expanding the role of peer supporter, promoting education of supported decision-making, protecting rights in the hospitalization process, improving human rights-based treatment environment, enacting and disseminating were suggested.
