Respondeat Superior and Employer Negligence in Sport-Related Violence

본 논문의 목적은 미국에서 일어난 스포츠 관련 가혹행위 및 성폭력 사례를 통하여 영미 과실 법상 단체책임의 법적 근거를 검토하고 스포츠 현장에서 생기는 사건·사고에 대한 단체책임을 고찰하는 데 있다. 근간에 미국에서 보고된 스포츠 관련 가혹행위 및 성폭력 사건들은 그 피해 규모와 빈도수를 고려할 때 가해자 개인에 대한 법적책임을 묻는 것만으로는 적절한 피해보상과 차후 유사 사건의 발생을 억제할 수 있는 효과가 거의 없다는 것을 보여준다. 이에 보다 포괄적인 보상과 근본적인 억제 효과를 창출해낼 수 있는 단체책임의 중요성이 대두되어, 본 연구의 필요성을 뒷받침하게 되었다. 먼저 미국 내 스포츠 관련 가혹행위 및 성폭력 사건을 통하여 사태의 심각성을 인지하고, 단체책임을 물을 수 있는 법적 근거를 검토해 보았다. 그 결과 개별사건의 성격에 따라 피해자는 사업장 책임론 (Premise Liability), 사용자 책임 및 과실론 (Respondeat Superior & Employer Negligence), 그리고 기타 연방법 (Tort Claims Act & Title IX)에 준거한 단체책임 소송을 제기할 수 있음을 확인하였다. 상기한 법체계의 맥락에서 미국 스포츠 현장에서 발생했던 사건들을 검토하고 관련된 이슈들을 추가로 고찰했다.

This study intends to examine legal doctrines of employer and institutional liability relating to violence and sexual assault committed by sport participants and employees in the context of recent legal cases in the United States. Given the frequency and gravity of the inflicted harm at issue, the paper recognizes that the imposition of individual tort liabilities would not be enough to create a proper level of tort compensation and effective deterrence effects. Thus, the study is warranted due to the importance of vicarious liability which would provide more reasonable tort compensation to victims. After exploring hazing and sexual violence cases in the U.S. to recognize the seriousness of the problem, legal grounds that would implicate sport organizations with legal liabilities were identified and explained. In sum, the article found that premise liability, respondeat superior, employer negligence, the Tort Claims Act, and the Title IX of the Education Amendment Act would provide legal causes of action for tort victims of violent incidents in sport context. Recent sport-related tort cases in the U.S. were analyzed in lights of the relevant jurisprudence.
