보복범죄에 대한 경찰의 대응 방안

Countermeasures of the Police to Retaliation Crime

최근 보복범죄가 흉포해지고 증가하고 있어 이에 대한 경찰의 강력한 대책 마련을 위한 목적을 두고 연구하였다. 현재 경찰은 제보자를 포함한 피해자의 인적사항과 연락처, 주소 등 정보에 대한 보안 유지와 신변안전조치 등을 포함하는 ‘보복범죄 방지종합대책’을 시행 중이다. 그러나 2022년 6월에는 대구 변호사 사무실 방화사건, 9월에는 신당역에서 스토킹 및 불법 촬영 등의 피해를 신고한 피해자가 가해자가 휘두른 흉기에 의해 사망하는 사건과 2023년 4월 서울 금천구에서 데이트폭력을 신고한 피해자에게 앙심을 품고 살해하는 보복범죄가 일어났다. 이와 같은 보복범죄가 계속적으로 발생하고 있고 경찰의 신변안전조치에 대한 실효성에 의문이 커지면서 많은 국민이 보복범죄에 대한 두려움과 우려를 호소하고 있다. 보복범죄에 대응하여 여러 제도가 시행되고 있음에도 불구하고 보복범죄는 계속 증가하는 추세다. 이에 보복범죄로부터 피해자 등의 신변을 보호하기 위한 혁신적인 경찰 활동 방안이 시급히 마련되어야 한다. 이에 본 연구는 신변안전조치 실패 사례를 포함한 보복범죄에 대한 경찰의 대응현황을 분석하고 현행 경찰 활동의 문제점을 도출한다. 이에 따라 현행 경찰의 범죄피해자 보호제도가 보복범죄로부터 피해자의 안전을 철저하게 보호할 대응방안을 고찰하고 그 결과로써 특신법상 신변안전조치 대상 범죄의 확대, 보복을 당할 우려를 판단하는 기준이 될 보복범죄 위험평가지표의 연구·개발, 구속사유에 보복범죄의 위험성 규정, 보복범죄 전담인력 및 전담부서의 설치·운영 등의 방안을 제시하였다.

The police is a national institution that plays a role in ensuring the life, property, and safety of citizens based on the general power of the state. Therefore, the people's policy demand for laws and systems that can carry out strong police activities against retaliatory crimes continues to increase. Currently, the police are implementing the “Comprehensive Measures to Prevent Retaliation Crimes,” which includes security maintenance and personal safety measures for information such as the personal details, contact details, and address of victims, including informants. However, on September 16, 2022, a victim who reported crimes such as stalking and illegal filming in the women's bathroom of Sindang Station in downtown Seoul was killed by a weapon wielded by the perpetrator. Accordingly, many citizens are complaining of fear and concern about retaliation crimes. In response to past retaliatory crimes, various police measures against retaliatory crimes are being implemented, but retaliatory crimes continue to increase. Accordingly, legal and institutional support necessary for police activities to protect victims of retaliation crimes must be created. Therefore, this study analyzes the police's response to retaliation crimes, including cases of failure to take personal safety measures and draw out the problems of current police activities. Accordingly, the current police crime victim protection system is intended to suggest an improvement plan that can thoroughly protect the safety of victims from retaliation crimes.
