공동주택 경비원의 감시적 근로자 승인여부에 관한 연구

A Study on Whether Security Guards in Apartment Houses are Approved for an Employee Engaged in Surveillance Work

공동주택 경비원에 대하여도 ｢경비업법｣이 적용된다. ｢경비업법｣이 적용된다면 허가받 은 경비업무 외의 업무에 경비원을 종사하게 할 수 없다. 그러나 ｢공동주택관리법｣의 개정 에 의하여 공동주택 경비원은 경비업무 외에 관리업무도 수행할 수 있게 되었다. 나아가 공동주택 경비원이 감시적 근로자로 승인받게 되면 ｢근로기준법｣의 근로시간, 휴게, 휴일 에 관한 규정이 적용되지 않아 열악한 상황에 처하게 된다. 이러한 일련의 과정이 과연 경비업의 발전에 도움이 되는지 의문이다. 따라서 본 연구에서는 ｢경비업법｣의 적용대상 이 되는 공동주택 경비원에 대하여 감시적 근로자 승인이 적절한 지 여부에 대하여 문헌연 구, 관련 법령 및 판례 등을 중심으로 연구하였다. 공동주택 경비원의 경우 경비업무 외 관리업무를 규칙적으로 자주 수행함으로써 그 시 간이 전체 업무 중 상당한 비중을 차지하고 전체 업무 강도가 낮다고 보기 어려운 경우에 해당한다고 볼 수 있다. 따라서 공동주택 경비원은 감시적 근로자로 승인받을 수 없는 것 으로 해석을 할 필요성이 있다. 이러한 해석에 의할 때 공동주택 경비원은 경비업무에 전념할 수 있고, 전문성도 강화될 수 있으며, 시민의 생명이나 신체, 재산에 대한 위험을 방지하고 안전을 지키는 준경찰력으 로서의 기능도 수행할 수 있게 될 것이다. 나아가 경비산업도 단순⋅노무직이 아닌 치안서 비스 산업으로 성장할 수 있을 것이다.

The ｢SECURITY SERVICES INDUSTRY ACT｣ also applies to apartment security guards. If the ｢SECURITY SERVICES INDUSTRY ACT｣ is applied, A security business entity shall not cause its security guards to engage in any service other than the licensed security services. However, under the ｢MULTI-FAMILY HOUSING MANAGEMENT ACT｣, apartment security guards can perform management tasks in addition to security tasks. Furthermore, if an apartment security guard is approved as an employee engaged in surveillance work, the provisions on work hours, recess, and holidays of the ｢LABOR STANDARDS ACT｣ are not applied, resulting in a poor situation. It is questionable whether this series of processes will help the development of the security industry. Therefore, this study focused on literature research, related laws, and precedents on whether an employee engaged in surveillance work approval is appropriate for apartment security guards subject to the ｢SECURITY SERVICES INDUSTRY ACT｣. In the case of apartment security guards, it is necessary to interpret them as unable to be approved as an employee engaged in surveillance work because they repeatedly perform management tasks other than security tasks. According to this interpretation, apartment security guards will have expertise and be able to function as a quasi-police force that protects the safety of citizens.
