국제사회의 북한 장애문제 인식 고찰: UN장애인권리협약 조약-보고체제 문서를 중심으로

Examining International Community's Perception of Disability Issues in North Korea: Focusing on the UN Convention on the Rights of Persons with Disabilities Treaty-Reporting System Documents

본 연구는 UN장애인권리협약의 조약-보고체제 문서들을 통하여, 국제사회에서 공론화되고 있는 북한의 장애문제와 그 특징에 대하여 고찰해 보았다. 본 연구에서 장애인권리위원회의 쟁점목록 및 시민사회조직의 병행보고서를 분석해본 결과, 북한의 장애문제는 ‘장애 비하적 용어’, ‘UN장애인인권특별보고관 권고 이행 및 재방북’, ‘장애여성의 영예군인과의 결혼 압력 관행’, ‘장애영아 살해’, ‘수감된 장애인’, ‘장애인 격리 수용’, ‘장애노동자에 대한 보조금’ 등으로 나타났다. 이러한 장애문제가 나타내는 바는 북한에 존재하고 있는 장애 문제가 어느 정도 검증이 되고, 시급히 해결해야 할 문제에 대한 국제적 공감대가 형성되었다는 것이며, 북한의 장애문제 대부분은 자유권, 그 중 일부는 생명권과 관련되어 있기에 즉각적 실현을 통해 권리보장이 이루어져야 할 정도로 장애인 인권 수준이 매우 열악하다는 것이다. 이상의 분석결과를 토대로 결론에서는 북한 장애인 권리보장 및 복지증진을 위한 방안을 제언하였다.

This study analyzes the international community's perception of North Korea's disability issues and their characteristics through the Treaty-Reporting System documents of the Convention on the Rights of Persons with Disabilities. Based on the analysis of the List of Issues of Committee on the Rights of Persons with Disabilities and the Parallel Reports of civil society organizations, this study found that North Korea's disability issues include ‘derogatory terms for disability’, ‘pressure on women with disabilities to marry honorary soldiers’, ‘killing of infants with disabilities’, ‘solation of persons with disabilities’, ‘imprisonment of persons with disabilities’, ‘subsidies for workers with disabilities’, and ‘implementation of the recommendations of the UN Special Rapporteur on the rights of persons with disabilities and revisit to North Korea’. What these disability issues indicate is that the existence of disability problems in North Korea has been verified to a certain extent and an international consensus has been formed on the issues that need to be addressed urgently, and that the level of human rights for persons with disabilities in North Korea is so poor that most of the disability issues are related to the civil rights and some of them to the right to life and should be immediately realized and guaranteed. Based on the above analysis, the conclusion recommends measures to ensure the rights and welfare of persons with disabilities in North Korea.
