예술인 창작안전망 구축을 위한 복지제도 개선 방안

Improvement plans on the welfare system to establish a creative safety net for artists

2011년「예술인 복지법」 이 제정되고 예술인들이 안정적이고 지속적으로 창작활동을 할 수 있게 하기 위해서 예술인 복지를 위해 지속적으로 많은 시도를 해왔으나 2013년 예술인 사회보장정책이 시작되어 법 시행이 10년 이상이 지난 이 시점에서도 여러 가지 문제점과 제도의 실효성에 대한 의문들이 문화예술의 각 분야에서 제기되고 있다. 현행「예술인 복지법」은 복지의 대상인 예술인의 정의와 기준에 대한 문제에서부터 복지사업 대상의 범위 및 재정마련 등의 문제들로 인해 예술인들을 법의 사각지대로 놓이게 하고 있다. 문화예술의 중요성에 대한 인식이 사회적으로 제고되면서 예술인에 대한 사회적 지위나 위상이 달라지고 있고 그런 관점에서 다양한 측면을 고려한 복지제도가 요구되고 있는 시점이다. 이 논문은 먼저 법에 근거한 예술인의 정의와 범위를 살펴보면서, 국외에서의 예술인의 사회적 지위를 어떻게 평가하고 있는지 검토하였고 예술인 복지법의 개정 변화를 조사하면서 창작안전망 보호를 위한 예술인 복지제도를 분석하여 문제점을 알아보았다. 더불어, 국외 예술인 복지제도와 정책관련 사례를 비교하고 분석했다. 그런 후에 예술인 복지제도에서 야기되는 문제점들에 대해 고찰하여 경제적으로 취약한 현실에 있는 예술인들을 위한 창작환경 개선을 위해 풀어야할 과제와 개선 방향을 제시하였다. 본 연구의 의의는 기존의 예술인 복지제도가 예술인의 창작환경 개선을 위해 해결해야할 과제를 제시하고 유럽 선진 국가의 예술인 복지제도를 분석함으로서 국내 예술인의 창작현실에 적합한 예술인 복지제도가 지속적으로 연구되고 개선되어야 함을 강조하고자 한다.

The Artists' Welfare Act was enacted in 2011, and many attempts have been made continuously for the welfare of artists, such as protecting artists' professional rights by law and expanding the social safety net. However, after the enforcement ordinance was promulgated in November 2012, the Artists' Social Security Policy was enacted in 2013. Even at this point, more than 10 years after the law began and went into effect, various problems and questions about the effectiveness of the system are being raised in each field of culture and arts. The current Artist Welfare Act places artists in a blind spot of the law due to issues such as the definition and scope of artists as welfare recipients, the scope of actual benefits, and the scope and budget of welfare projects. As social awareness of the importance of culture and arts is increasing, the social status and status of artists are changing, and efforts are being made at the government level to provide various welfare services. This paper ftrst examines the definition and scope of artists based on the law, examines how the social status of artists is evaluated overseas, and analy􀂝s the artist welfare system to protect the creative safety net while examining changes in the revision of the Artist Welfare Act. I looked into it. In addition, we compared and analy overseas artist welfare systems and policy-related cases. A:fteiwards, we looked at the problems arising from the artist welfare system and presented tasks and directions for improvement to improve the creative environment for artists in economically vulnerable situations. The significance of this study is to present tasks that the artist welfare system currently implemented in Korea must solve to improve the creative environment for artists and to improve the artist welfare system suitable for the creative reality of domestic artists by analyzing the artist welfare systems of european advanced countries.
