교육부의 공주교육대학교 총장 임용제청 거부과정에 대한 비판적 고찰

A Critical Reflection on the Refusal to Request the Appointment of the President of Gongju National University of Education

이 논문은 총장임용 관계 법규에 의거하여 선출된 공주교대 총장의 임용제청거부과정을 비판적으로 고찰하는데 연구의 목적을 두었다. 이를 위해 공주교대 총장임용후보자인 L교수가 그간 작성한 일지, 총장임용제청을 위해 자문했던 24명의 면담, 전화통화, 문자메시지, 언론 보도 내용을 분석하였다. 이러한 각종 기록들을 종합하여, 총장 임용제청거부과정을 정부의 인사검증기준, 인사검증기관, 임용제청 거부통보, 임용제청 거부사유, 임용제청 거부주체, 임용제청 거부의 배경이라는 주제를 중심으로 정리하였다. 연구결과, 첫째, 정부의 인사검증기준은 고위 공무원의 7대 비리 기준이 아닌 전문성, 도덕성, 준법성의 기준이 적용되었다. 둘째, 인사 검증 기관은 공식적으로 경찰청으로 되어 있으나, 국정원이 관련한 것으로 나타났다. 셋째, 임용제청 거부 처분시 거부의 사유를 제시하지 않았다. 넷째, 임용제청 거부 사유가 명확하지 않을 뿐 아니라 거부 사유에 대한 소명 기회를 제공하지 않았다. 다섯째, 임용제청 거부 주체는 교육부 인사위원회로 되어 있으나 실질적으로는 청와대에서 이루어지고 있음을 추론할 수 있었다. 여섯째, 임용제청 거부는 검정교과서 비판에 대한 정치적 및 이념적 차이에 기인한 것으로 추론하였다. 이러한 것을 종합하면, 공주교대총장 임용제청 거부에는 정치적･이념적 성향이 반영된 것으로 볼 수 있다. 본 연구 결과에 의하면 다음과 같은 시사점을 도출할 수 있었다. 국립대 총장 선거출마 자격 기준은 대학 스스로 정하도록 규정하고 직선제로 선출된 총장임명은 헌법의 기본가치인 대학의 자율성 보장을 위해 당연 임용되도록 법과 제도의 개선이 요구된다.

This paper aims to critically examine the process of rejecting the appointment recommendation for the president of Gongju National University of Education, who was elected in accordance with the relevant regulations governing university president appointments. To achieve this, the study analyzed a variety of records, including diaries written by Professor L, a candidate for the presidency, interviews with 24 advisors, phone calls, text messages, and media reports. As a result of the study, the government's personnel verification criteria were not applied to the refusal to propose the appointment of the president of Gongju National University of Education, and the National Intelligence Service was involved. In addition, at the time of the rejection disposition, the ‘reason for rejection’ was not presented, and the appointment proposal was later rejected due to personal flaws. It was found that the decision to propose an appointment was made in a Top-Down method. In conclusion, it was found that the refusal to propose the appointment of the President of the Gongju National University of Education was politically and ideologically made. In the future, the university will have to decide on its own. In addition, the system improvement is required to ensure the autonomy of universities, which is the basic value of the constitution, in the appointment of the president elected by direct election.
