교육의 정치적 중립성이 교육감 선거에 미치는 영향 분석 : 교육감과 시･도지사 선거비용 비교를 중심으로

Analysis of the Impact of Political Neutrality in Education on Superintendent Elections : Focusing on Comparative the Cost of Electing Superintendents and Governors

교육감 선거는 헌법에서 명시하는 교육의 정치적 중립성으로 정당의 관여를 금지하고 있다. 하지만 교육감 후보자는 정당 기반의 공직선거법으로 선거를 치르고 있으며, 정당에서 추천한 시･도지사 선거와 동일한 기준으로 선거비용 사용을 적용받고 있다. 본 연구에서는 정치적 중립성의 영향을 받는 교육감 선거가 시･도지사 선거와 어떤 차이가 있는지를 선거비용 운영상의 차이 분석을 통해 확인하였다. 이를 위해 중앙선거관리위원회의 공식적인 선거비용 자료를 바탕으로 선거비용에 대한 확보와 지출을 비교하였다. 확보는 후보자의 자산과 후원금, 정당지원금을 비교하였고, 지출은 선거비용제한액, 선거비용보전액, 세부지출항목을 비교하였으며, 교육감과 시･도지사 선거에서 선거비용을 총괄하는 회계책임자 5명을 선정하여 면담을 진행하여 선거비용 운영상의 차이를 분석하였다. 이를 바탕으로 특수성의 조건을 가지고 있는 교육감 선거에 맞는 기준과 방식에 대해 교육적 실천을 논의하였고, 교육감 선거만을 위한 특칙조항이나 공영제 방식 등 선거비용 제도의 재정립에 대해 제안하였다.

The superintendent election prohibits the involvement of political parties in accordance with the constitution, which specifies the political neutrality of education. However, superintendent candidates participate in elections by applying the Public Official Election Act based on party affiliation. They also incur election expenses based on the same criteria recommended by the party for governors candidates. The purpose of this study is to examine how superintendent elections, influenced by political neutrality, differ from governors elections, through the analysis of election violation cases and the analysis of differences in election expenses. Additionally, to examine differences in election expenses, the study compared the income and expenditures of superintendents and governors based on official election expense data from the National Election Commission. The study compared candidate assets, campaign contributions, and party support funds for income, and election expense limit, expense coverage limit, and detailed expenditure items for expenditures. Furthermore, the study selected five accounting officers overseeing election expenses in both superintendent and governors elections, conducted interviews, and explored differences in election expense operations. Recognizing that the election of the superintendent has the specific condition, educational practice was discussed on issues that require standards and methods suitable for the election of the superintendent. The superintendent election system should suggested the re-establishment of the election cost system, such as special provisions for the election of superintendents only and the public system.
