서울시 사회복지시설의 장애인 인권침해 실태 : 타 시설 이용자와의 비교분석을 중심으로

Status of Human Rights Violation of Persons with Disabilities in Social Welfare Facilities in Seoul: Focusing on Comparative Analysis of Other Facilities Users

최근에도 사회복지시설 이용자의 인권침해 예방을 위한 안전망이 강화되어야 한다는 필요성이 대두되고 있다. 본 연구의 목적은 서울시 사회복지시설에서의 이용자 인권침해 실태를 파악하는 것에 있다. 이를 위해 본 연구는 사회복지시설에서 발생하는 종사자로부터의 인권침해, 타 이용자로부터의 인권침해 실태에 주목하고, 장애인에 대한 인권침해 실태와 그 수준을 비교적인 관점에서 파악하기 위해 장애인을 중심으로 저소득 지역주민, 노인, 노숙인 등의 취약계층과의 비교·분석을 실시하였다. 결과적으로, 서울시 사회복지시설 이용자의 인권침해는 매우 드물게 발생하고 있긴 하지만, 장애인 복지시설에서 신체적 침해, 정서적 침해, 방치 등의 인권침해가 타 복지시설보다 비교적 높게 나타나고 있음을 발견하였다. 또한 장애인 복지시설에서 타 이용자로부터 이용자의 정서적 침해, 신체적 침해 등의 인권침해가 타 복지시설에 비해 상대적으로 높게 발생하고 있음도 확인되었다. 이러한 연구결과는 향후 법률과 규제, 교육과 인식 개선, 신속하고 효과적인 대응(대처), 보호자 및 지원기관 지원, 사회적 책임 등 장애인 인권침해 문제를 해결하기 위한 다양한 방안을 마련하는데 있어 기여할 수 있다는 정책적 함의를 가진다.

In recent years, there is a need to strengthen the safety net to prevent human rights violations of social welfare facility users. The purpose of this study is to understand the status of human rights violations of users in social welfare facilities in Seoul. To this end, this study focused on human rights violations from workers and human rights violations from other users in social welfare facilities, and compared and analyzed with vulnerable groups such as low-income local residents, the elderly, and the homeless, focusing on the disabled, to understand the status and level of human rights violations against the disabled from a relatively perspective. As a result, although human rights violations by users of social welfare facilities in Seoul are very rare, human rights violations such as physical violations, emotional violations, and neglect are relatively higher than those of other welfare facilities. It was also confirmed that human rights violations such as emotional and physical violations of users from other users are relatively higher in welfare facilities for the disabled than in other welfare facilities. These findings have policy implications that can contribute to solving human rights violations for the disabled, such as laws and regulations, education and awareness improvement, rapid and effective response (counteraction), support for guardians and supporting organizations, and social responsibility in the future.
