특별자치시도 설치에 따른 교육행정감사의 쟁점과 과제

Issues and Tasks for Educational Administration Audit with the Establishment of Special Self-Governing City and Province

본 연구는 전국에서 4개 특별자치시 도가 출범함에 따라 고도의 자치권을 보장하고자 설치된 특별자치시 도에서 지방자치단체와 지방교육자치단체 간의 관계 설정이 필요한 시점에서 양자의 관계를 교육행정감사를 중심으로 살펴보고, 특별자치시 도에서 교육의 자율성 및 전문성 등을 충분히 확보할 수 있는 교육행정감사를 운영하기 위해 관련 법령에 어떠한 쟁점이 있고 이를 해소하기 위한 과제가 무엇인지 살펴봄으로써 바람직한 교육자치의 방향을 모색하고자 한다. 연구 결과 현행 특별자치시 도의 설치에 관한 법률 및 관련 조례 모두 지방교육자치와 교육행정감사에 제약 요인이 있는 것으로 나타났고, 이는 교육자치 및 교육행정감사의 정치적 중립성을 충분히 보장하지 못할 뿐만 아니라 교육행정감사의 비효율을 초래할 우려가 있으므로 이러한 논의를 바탕으로 지방교육자치와 교육행정감사의 정치적 중립성 및 전문성을 제고할 수 있도록 관련 법령에 대한 개정 필요성에 대해 제시하였다.

With the establishment of four special autonomous regions and provinces across the country, it is necessary to establish a relationship between local governments and local educational administrations in special autonomous regions and provinces that guarantees a high degree of autonomy. This study aims to explore the direction of desirable educational autonomy by examining the relationship between local governments and local educational administrations, focusing on educational administrators and examining what issues are in the relevant laws and regulations as well as what challenges need to be resolved in order to operate educational administrators that can fully secure educational autonomy and professionalism in special autonomous regions and provinces. As a result of this study, it was found that both the current Act on the Establishment of Special Autonomous Regions and related ordinances have constraints on local education autonomy and educational administrative audit, which may not sufficiently guarantee the political neutrality of educational autonomy and educational administrative audit, and may lead to inefficiency of educational administrative audit. Based on this discussion, it is suggested that the relevant laws should be revised to enhance the political neutrality and professionalism of local educational autonomy and educational administrative audit.
