K-Pop은 안무를 통해 전 세계적으로 사랑받는 음악 장르로 자리 잡았다. 특히, 대중의 시선을 끄는 포인트 안무는 음악의 인기에 중요한 요소로 작용하며, 다양한 플랫폼을 통해 안무 콘텐츠가 공유되고 있다. 그러나 안무가들은 창작에 대한 저작권 보호와 보상에서 소외되어 있다. 이에 이 연구에서는 최근 선고된 미국 판례에 대한 분석, 인터뷰를 통해 확인한 일반 대중들이 안무 저작권과 관련하여 갖고 있는 의문점 관련 쟁점에 대한 판례 분석을 통해 안무저작물의 보호범위 및 안무에 대한 저작물성을 인정하는 기준을 보다 구체적으로 제시하고자 한다. 나아가, 안무가들에 대한 인터뷰를 통해 안무가와 기획사 간 작성하는 계약서에 다양한 형태로 저작권 행사가 제한됨을 알 수 있었는데, 해당 쟁점에 관한 판례 검토를 통해 부당한 계약임에도 무효 주장에 한계가 있음을 확인하였다. 이에 안무가 성명표시, 표준계약서 정비, 안무 저작권료 지급을 위한 신탁관리단체의 설립, 관련 법 개정을 통한 추가보상요구권 신설 등 안무 저작권을 보다 실효적으로 보호할 수 있는 방법에 관하여 제안한다.
K-Pop has established itself as a beloved music genre around the world through choreography. In particular, choreography, which attracts the public's attention, acts as an important factor in the popularity of music, and choreography contents are shared through various platforms. However, choreographers are alienated from copyright protection and compensation for creation. This study aims to present more specific criteria for acknowledging the scope of protection of choreographic works and copyrightability for choreography through analysis of precedents on issues related to questions related to choreography by the general public confirmed through interviews and analysis of recently sentenced U.S. precedents. Furthermore, through interviews with choreographers, it was found that the exercise of copyright was limited in various forms in the contract prepared between the choreographer and the agency, and through a review of precedents on the issue, it was confirmed that there is a limit to the claim of invalidity even though it is an unfair contract. Accordingly, we propose a method to more effectively protect choreography copyrights, such as expressing names, reorganizing standard contracts, establishing a trust management organization to pay choreography copyrights, and establishing additional compensation claims through revision of related laws.
