국가 차원 인재양성 정책의 실효성 제고를 위한 ｢국가인재양성기본법｣ 제정 방안

Legislative Measures for Enacting the National Talent Development Basic Act to Enhance the Effectiveness of National Talent Development Policies

본 연구는 기술 혁신, 인구구조 변화, 초연결 사회로의 이행 등 급변하는 사회적 환경 속에서 국가 차원의 전략적 인재양성 정책의 필요성을 제기하고, ｢국가인재양성기본법｣ 제정 방향을 모색하는 데 목적을 두었다. 이를 위해, 관련 법조문과 문헌을 분석하고 전문가 자문을 바탕으로 현행법 및 관련 법률을 종합적으로 검토하였다. 먼저, 현행 ｢인적자원개발기본법｣의 법적･제도적 한계를 분석하고, 실효성 저하 요인을 도출하였다. 또한, 현행법과 유사 입법 사례인 ｢과학기술기본법｣을 비교･분석하여 법체계, 정책 실행 구조, 조정 기제의 차이를 검토하고, 국가 인재양성 정책의 법적･제도적 실효성을 강화하기 위한 시사점을 도출하였다. 마지막으로, 2023년 발의된 ｢국가인재양성기본법(안)｣을 중심으로 법안의 수정 및 보완 방향을 제시하고, 법적･제도적 개선 방안을 구체화하였다. 본 연구는 국가인재양성 정책의 체계적 설계를 위한 법적 기반을 마련하는 데 기여하며, 국가 경쟁력 강화를 위한 지속 가능한 인재양성 체계 구축에 실질적인 시사점을 제시하였다.

This study examines the necessity of a strategic national talent development policy in response to rapid societal changes, including technological innovation, demographic shifts, and the transition to a hyper-connected society. It analyzes the legal and institutional limitations of the Framework Act on the Development of Human Resources and compares them with those of the Framework Act on Science and Technology, focusing on differences in legal structures, policy implementation, and coordination mechanisms. Based on this analysis, key insights are derived to strengthen the legal and institutional framework for national talent development policies. Additionally, the study reviews the proposed National Talent Development Basic Act (2023) and provides recommendations for its revision and refinement. By providing insights into legal and policy improvements, it contributes to the systematic development of a sustainable national talent development system designed to enhance national competitiveness.
