국가보훈보상체계의 합리적 재조정 모색

A Study on Reorganization of the National Veterans Compensation System

<국가보훈처>가 2023년 6월 5일 <국가보훈부>로 62년 만에 부로 승격되었고 국가보훈에 관한 주요 시책을 심의·의결하는 <국가보훈위원회>도 ‘제5차 국가보훈발전 기본계획’을 확정했다. 이를 계기로 그동안 국가유공자 보상체계가 통일된 이념이나 기준 없이 형성되고 체계적으로 발전되지 못했던 점을 전반적으로 검토하여, 합리적으로 재조정할 필요가 있다. <국가보훈부> 승격에 맞추어 보훈보상원칙의 재정립, 보상체계의 조정, 보훈정책 중 복지정책과 겹치는 내용들의 합리적 재조정, 보상금 증가로 인한 부담을 줄이기 위한 국가경제 실정에 따른 보상금 지급의 탄력적 조절 기준 모색 등의 대안들을 모색할 필요가 있다. 구체적으로 보훈보상 기본 개념과 원칙의 부족, 미흡한 적절 보상 수준과 객관적인 형평성 문제, 보훈 보상 대상자 확대와 새로운 대상자 추가 기준의 난립 등의 문제점을 짚어 보고 대안을 마련할 필요가 있다. 이중 무엇보다도 우선할 부분은 그동안 국가유공자의 범위가 지속적으로 너무 확대되어 있어 보훈 영역에 편입될 수 없는 행위에 대해서도 보훈 영역으로 진입하려는 요구를 가져오게 되었기 때문에 보훈보상 범위와 대상 및 구분에 대한 정확하고도 명확한 재규정이 필요하다. 그러기 위해서는 보훈정책과 관련된 개념이 새로이 정비되어야 하며 특히, 보훈정책은 정치적 고려의 차원이 아닌 순수한 보훈 차원에서 만들어지고 시행되어야 한다. 이를 바탕으로 보훈정책 전반을 포괄할 수 있는 종합적이고 통일적인 법체계를 수립하고 그 위에 개별법을 정비하여 형평에 맞는 법령적용체계를 마련해야 한다.

However, for a long time, the compensation system for national merit has not been established and systematically developed based on one common ideology or standard. In this regard, it is necessary to seek alternatives, such as, re-establishing the principle of veterans' compensation, adjusting the compensation system, transferring the contents overlapping with the welfare policy among veterans' policies to welfare policies, and seeking flexible control standards for compensation payments according to the national economic situation to reduce the burden of increased compensation. Specifically, it is necessary to come up with alternatives by examining problems, such as, the lack of basic principles for veterans' compensation, insufficient appropriate level of compensation and objective equity issues, the expansion of targets, and the turmoil of additional standards for new targets. Above all, it is necessary to accurately and clearly define the scope of national merit that has been so expanded that even actions that cannot be incorporated into the field of veterans have led to a demand to enter the field of veterans. In order to do this, the concept related to veterans policy must be reorganized, and in particular, veterans policy must be created and implemented at the level of pure veterans, not at the level of political consideration. Based on this, a comprehensive and unified legal system that can cover the entire veterans policy should be established, and individual laws should be reorganized on top of it to establish a legal application system that is appropriate for equity.
