국제법상 강제실종 관점에서 본 전시납북자 문제 해결을 위한 노력과 과제

Efforts and Tasks for Solving the Problem of Abductees from the Perspective of Enforced Disappearance under International Law

전시납북자 문제는 ‘강제실종’ 관련해 국제인도법 및 국제인권법 그리고 전환기 정의와 연계된다. 북한에 의해 자행된 전시납북 행위는 국제인도법상 전시 민간인 강제이송 관련한 「제4차 제네바 협약」을 중대하게 위반한 것이며, 국제인권법 차원에서도 강제실종이 ‘만연하게’ 또는 ‘조직적’으로 이뤄지는 경우, 국제법상 인도에 반한 죄가 될 수 있다. 또한 전환기 정의 측면에서 볼 때, 전시납북피해 문제 해결을 위한 사법적 정의와 비사법적 정의가 요구되고 있다. 전시납북자 문제는 사안 자체가 지닌 해결의 당위성은 물론이고 전시납북 피해자들과 그 가족들의 연령 등 현실적 측면을 고려할 때, 매우 시급한 현안이자 장기적인 접근이 동시에 필요한 사안이다. 본 연구는 납북자 문제 해결을 위해 다음의 3가지 차원에서 방향성을 제시하였다. 첫째, 대통령의 광복절 경축사, 유엔 총회 기조연설 등을 활용해 대화 의지를 지속 천명하여야 한다. 둘째, 국내 차원에서 국민들에게는 납북자 문제가 잊히지 않도록 하고, 다른 한편으로 다음 세대 사후 준비가 필요하다. 셋째, 국제사회 차원에서는 납북자 문제해결을 위한 인권외교를 강화하여야 하며, 구체적으로 국가별정례인권검토(UPR) 제도의 활용 방안을 강구해야 한다.

The issue of wartime abductees is intricately linked to international humanitarian law, international human rights law, and the concept of transitional justice concerning ‘forced disappearance’. North Korea’s wartime abductions represent a serious violation of the Fourth Geneva Convention, which prohibits the forced transfer of civilians during war under international humanitarian law. If such forced disappearances are conducted in a ‘blatant’ or ‘organized’ manner, they may constitute crimes against humanity under international law. In terms of transitional justice, both judicial and non-judicial measures are required to address the issue of wartime abductees. This issue is both urgent and requires a long-term approach, considering practical aspects such as the aging of victims and their families, alongside the moral imperative to resolve the issue. This study proposes solutions across three dimensions. First, the president should consistently express a willingness to engage in dialogue through speeches on National Liberation Day and at the UN General Assembly. Second, domestically, it is crucial to keep the issue of abductees in the public consciousness while preparing for the involvement of future generations. Third, at the international level, human rights diplomacy must be strengthened to address the abductees issue, specifically by devising strategies to leverage the Universal Periodic Review (UPR) system for each country.
