책임, 자유의지, 그리고 교육 : 교원의 아동학대 면책에 관한 철학적 근거

본 연구에서 주장하는 바는 책임질 수 있는 성인을 길러내는 교육이 가능하기 위해 교원의 아동학대 면책이 요구된다는 것이다. Ⅱ장에서는 형법의 기본 원리인 ‘책임주의’로부터 도출되는 ‘책임’ 개념 및 그와 관련된 쟁점을 살펴보고, 자유의지의 존재를 논증하는 데닛의 견해와 윤리에 관한 계보학적 탐구를 통해 책임주의를 정당화한다. 이 과정에서 ‘책임’은 생물학적 유전뿐만 아니라, 문화적 복제자인 밈(meme)이 공진화한 산물이라는 점이 드러날 것이다. Ⅲ장에서는 책임이 귀속되는 자아가 단일한 실재가 아닌, 이야기의 무게중심이자 밈의 복합체임을 밝힌다. 이로부터 책임질 수 있는 자아를 길러내는 교육이 책임주의에 중요한 요소임을 확인한다. 이를 통해 본고는 교원의 아동학대 면책을 지지하는 철학적 근거를 제시한다.

This study contends that, in order to facilitate education that cultivates responsible adults, it is essential to grant teachers immunity from child abuse charges. To substantiate this claim, Chapter II explores the concept of “responsibility” as derived from the foundational principle of criminal law, Schuldprinzip (the principle of responsibility), and lays groundwork for the discussion by establishing its justification. This principle inherently assumes the existence of free will and a normative orientation. Accordingly, this study validates the principle of responsibility through Dennett’s defense of free will and a genealogical examination of morality. Through this analysis, it becomes evident that responsibility is not merely an inherited trait but also a construct that is transmitted and perpetuated through cultural replicators or “memes”. Furthermore, Chapter III illustrates that the self—to which responsibility is ascribed—is not a singular, fixed entity, but rather a dynamic center of narrative gravity formed through the complex interplay of multiple memes. Building on this premise, this discussion emphasizess the critical role of education in the attribution of responsibility, arguing that fostering a self capable of assuming responsibility is fundamental to sustaining the principle of responsibility. Thus, the paper presents a philosophical foundation for endorsing the teachers’ immunity from child abuse charges.
