학교폭력문제에 대한 법적·정책적 개선방안 연구

A Study on the Legal and Policy Improvement Measures for School Violence

본 연구는 학교폭력 문제에 대한 현행 법적·정책적 검토를 통해 보다 효과적인 대응 방안을 제시하는 것을 목적으로 한다. 1990년대 후반 이후 학교폭력 사건이 심각한 사회적 문제로 대두되면서, 기존의 학칙이나 교육부 지침만으로는 실효적인 대응이 어렵다는 지적이 제기되었다. 이에 따라 2004년 학교폭력예방 및 대책에 관한 법률이 제정되었으며, 이후 여러 차례 개정을 거쳐왔다. 하지만 여전히 실효성 부족, 피해자 보호 미흡, 가해자 선도 조치의 실효적 한계 등의 문제가 존재한다. 본 연구에서는 학교폭력예방법의 개정 방향과 학교폭력대책심의위원회의 운영 개선방안을 중심으로 검토하며, 궁극적으로 보다 효과적인 학교 폭력 대응 방안을 모색한다.

The purpose of this study is to present more effective countermeasures through the current legal and policy review of the school violence problem. As school violence cases have emerged as a serious social problem since the late 1990s, it has been pointed out that it is difficult to respond effectively only with existing school regulations or guidelines from the Ministry of Education. Accordingly, the Act on the Prevention and Countermeasures of School Violence was enacted in 2004, and has been revised several times since then. However, there are still problems such as lack of effectiveness, lack of protection of victims, and effective limitations of leading measures for perpetrators. This study examines the direction of the revision of the School Violence Prevention Act and how to improve the operation of the School Violence Countermeasures Review Committee, and ultimately seeks more effective ways to respond to school violence.
