정신건강사회복지사의 문화적 역량 강화를 위한 연구 : 법령 및 지침 분석을 중심으로

A Study on Enhancing the Cultural Competence of Mental Health Social Workers : Focusing on Analysis of Laws and Guidelines

다문화 사회로의 급속한 이행 속에서 이주배경 클라이언트를 위한 정신건강 서비스 수요가증가하고 있으며, 이에 따라 정신건강사회복지사의 문화적 역량은 서비스의 질과 접근성을결정짓는 핵심 요소로 부각되고 있다. 본 연구는 정신건강사회복지사가 이주배경 클라이언트를 위한 상담・치료 과정에서 문화적 역량을 효과적으로 발휘할 수 있도록, 관련 법규와지침을 중심으로 분석하였다. 분석 결과, 주요 법규와 지침들은 문화적 역량에 대한 기본이념을 부분적으로 반영하고 있었으나, ‘문화적 역량’의 명확한 정의, 교육 및 훈련 체계, 평가 시스템 등은 문서 간 일관성이 부족하고 실천 현장에서의 적용에 한계가 있는 것으로나타났다. 또한, 언어 접근성 향상을 위한 내용은 일부 포함되어 있으나, 실무자가 활용할수 있는 구체적인 절차 및 기관 간 협업 시스템은 미비한 수준에 그쳤다. 본 연구는 정신건강사회복지사의 문화적 역량 강화를 위한 법제적 기반 마련과 실천 지침의 제도화를 강조함으로써, 실천 현장과 정책 간의 연계를 촉진하는 기초자료로서 의의를 갖는다.

Amid the rapid transition to a multicultural society, the demand for mental health services for clients with migrant backgrounds has been steadily increasing. In this context, the cultural competence of mental health social workers is emerging as a critical factor influencing both the quality and accessibility of services. This study aims to explore the institutional foundations that support the enhancement of cultural competence among mental health social workers, particularly in the context of counseling and therapy for clients with migrant backgrounds, by analyzing relevant laws and guidelines. In addition, four supplementary laws—the Social Welfare Services Act, the Multicultural Families Support Act, the Child Welfare Act, and the Youth Welfare Support Act—were reviewed in light of their connections to the Mental Health Welfare Act. The analysis revealed that while the reviewed laws and guidelines partially reflect the foundational principles of ‘cultural competence’, they lack a clear and consistent definition of the concept, as well as systematic frameworks for education, training, and evaluation. Moreover, although some provisions address language accessibility, they fall short of offering practical procedures and inter-agency collaboration systems that practitioners can readily utilize. This study underscores the need to establish a comprehensive legal and institutional framework for enhancing the cultural competence of mental health social workers, and it emphasizes the importance of institutionalizing practical guidelines. The findings are expected to serve as a foundational resource for bridging policy and practice, and for advancing culturally responsive mental health services in Korea’s evolving multicultural society.
