교육공무원 공무상 재해보상 개선 방안 탐색 - 공무상 재해심사 현황 분석을 중심으로 -

Improvement Measures for Accident Compensation Reflecting the Job Characteristics of Teachers

본 연구는 교육공무원의 공무상 재해심사 현황 분석을 통해 교육공무원의 직무특성을 반영할 수 있는 재해보상 개선 방안을 탐색하는 데 목적이 있다. 이를 위해 2020-2024년 인사혁신처의 공무원 재해심사 현황 자료를 활용하여 교육공무원과 다른 직렬 공무원의 재해보상 청구 및 승인 현황을 비교·분석하였다. 연구결과, 교육공무원은 사고보다는 질병으로 인한 재해보상 청구·승인이 많았으며, 질병 중 정신질환의 청구·승인 비율이 높았다. 교육공무원의 정신질환 재해보상 청구·승인은 2020년 이후 지속적으로 증가하였으며, 2024년에는 전년 대비 청구는 90%, 승인은 72% 증가하였다. 연구 결과를 바탕으로 교원의 직무특성이 반영된 공무상 질병 판정 기준 마련, 희귀질환 등 인과관계 입증이 곤란한 사안에 대한 처리절차 마련, 재해보상심사위원회 구성 시 교육분야 전문가 포함, 교원양성기관 교육과정 또는 교원 직무연수 과정에 재해보상 관련 내용 포함 등을 제안하였다.

This study analyzes the current status of disaster compensation reviews for public officials and explores how the job characteristics of educational public officials can be reflected in the disaster compensation review process, and its implications. The findings indicate that for educational public officials, compensation claims and approvals are more frequently related to illnesses than to accidents (injuries). Among illnesses, mental disorders had the highest number of claims and approvals, with a notably high approval rate. Based on the results, this study proposes four measures. The first is establishing criteria for recognizing occupational diseases that reflect the specific job characteristics of educational public officials. Second, developing procedures for handling cases in which causal relationships are difficult to prove, such as rare diseases. Third, including experts from the educational sector in the Occupational Injury Compensation Review Committee. Finally, it proposes incorporating content related to occupational injury compensation into the curricula of teacher-training institutions.
