권리중심 중증장애인 맞춤형 공공일자리 사업의 성과와 과제: 경기도 사업 이해관계자 관점을 중심으로

Outcomes and Challenges of the Rights-Based Customized Public Job Program for Persons with Severe Disabilities: Focusing on the Perspective of Gyeonggi-do Province’s Stakeholders

권리중심 중증장애인 맞춤형 공공일자리는 자본주의 노동시장에서 배제된 중증 및 최중증 장애인의 노동권 확보에 주력하고, 이를 통해 생산성 중심 노동이 아닌 권리에 기반한 노동 패러다임으로의 전환을 촉진시켰다. 본 연구는 다양한 이해관계자 관점에서 권리중심 중증장애인 맞춤형 공공일자리사업의 방향성과 의미, 성과와 한계, 개선방안을 탐색함으로써 기존 장애인 일자리와 차별화된 권리중심 공공일자리의 사회적 가치를 이해하고 나아가야 할 방향을 제시하고자 하였다. 본 연구결과 권리중심 공공일자리는 중증장애인의 노동을 통해 UN 장애인권리협약을 이행하고 실현하여 사회적 가치를 재생산하는 공적 노동으로서의 함의를 지니고 있음을 알 수 있다. 다만 사업 운영 과정에서 타 장애인 일자리와의 가치 충돌 문제와 1년 단위 위탁사업의 형태에서 야기되는 불안정 노동 및 수행기관의 부담 가중 등의 한계를 지니고 있었으며, 이에 사업의 제도화를 통한 지속성 확대, 전체 장애인 일자리와의 유기적 공생을 이루기 위한 참여자 선발 기준 명확화와 같은 개선 방안이 도출되었다.

The Rights-Based Public Job Program focuses on securing the labor rights of people with severe or profound disabilities, who were excluded from the capitalist labor market, and through this, promotes the transition to a rights-based paradigm based on rights rather than productivity-based labor. The study aimed to understand the social value of rights-based public jobs, which are differentiated from existing jobs, by exploring their implications, outcomes, limitations, and recommendations for improvement. For this, 19 stakeholders were interviewed. As a result of this study, it can be seen that rights-based public jobs have implications as labor that realizes the value of the UN Convention on the Rights of Persons with Disabilities through the labor of the Severely Disabled and reproduces social values. However, in the process of operating the project, there were limitations such as value conflicts with other employment support policies, unstable employment due to the type of annual consignment business, and the burden of consignment agencies. Accordingly, legal institutionalization was proposed to expand the sustainability of the project. And it is necessary to clarify the criteria for selecting participants to achieve organic symbiosis with other employment support services for the disabled.
