The UK’s AI Governance Strategy: Building Trust as Infrastructure

본 연구는 브렉시트 이후 영국이 ‘차세대 기술의 규칙을 설계하는 국가’로 이동하며 구축한 AI 거버넌스(원칙, 맥락, 비례성을 축으로 한 규제 철학, 민첩하고 유연한 표준화 방식, 그리고 제3자 검증 중심의 AI 보증)의 형성과 작동 방식을 체계적으로 분석한다. 상원 AI 특별위원회(2017–18)에서 국가 AI 전략 (2021), AI 규제 백서(2023)로 이어지는 정책 연속성을 추적하고, AI 표준 허브, BSI Flex, AI 보증 로드맵 등 제도적 장치가 신뢰, 혁신, 무역이라는 목표와 어떻게 결합되는지를 분석한다. 주요 발견은 다음과 같다. (1) 영국은 일괄적 법제화 대신 원칙 기반, 맥락 민감형 설계를 통해 규제 파편화와 집행 역량 문제를 표준 및 보증으로 보완한다. (2) 표준화는 혁신 인프라이자 시장 신뢰 메커니즘으로 기능하며, 보증은 ‘신뢰 통화’를 창출하는 전문 서비스 산업으로 진화하고 있다. (3) 이 모델은 EU의 집행력, 미국의 민첩성 사이에서 규제–시장 간 조정 능력을 제공하지만, 법적 구속력 및 국제 정합성 확보가 향후 과제다. 한국을 위한 정책적 함의로, 원칙 기반 규제 프레임, 민첩한 표준화 경로, 보증 생태계 구축, 다중 이해관계자 거버넌스, 국제 규범 선도를 제안한다.

This study provides a systematic analysis of how the United Kingdom, following Brexit, has repositioned itself as a “rule-shaper” in next-generation technologies by constructing a distinctive model of AI governance. Focusing on the formation and operation of the UK’s governance framework—built upon principles, context sensitivity, and proportionality—this study examines the country’s regulatory philosophy, agile and flexible approaches to standardization, and third-party verification-based AI assurance ecosystem. It traces the policy continuity from the House of Lords Select Committee on Artificial Intelligence (2017–2018) through the National AI Strategy (2021) and the AI Regulation White Paper (2023), and analyzes how institutional mechanisms such as the AI Standards Hub, BSI Flex, and the AI Assurance Roadmap integrate the policy objectives of trust, innovation, and trade. The findings are threefold: (1) The UK complements fragmented regulation and limited enforcement capacity through a principles-based, context-sensitive regulatory design supported by standardization and assurance mechanisms. (2) Standardization functions not only as innovation infrastructure but also as a market trust mechanism, while AI assurance is evolving into a professional service industry that generates a “currency of trust.” (3) Positioned between the EU’s regulatory rigor and the U.S.’s market-driven flexibility, the UK’s hybrid model provides coordination between regulation and innovation, though challenges remain regarding legal enforceability and global interoperability. For Korea, this study offers five policy implications: adopting a principles-based regulatory framework, institutionalizing agile standardization pathways, developing an AI assurance ecosystem, fostering multi-stakeholder governance, and strengthening leadership in global rule-setting.
