Legal and Institutional Considerations for Strengthening Ethics in E-Sports

e스포츠는 단순한 여가 활동을넘어 전 세계적으로 빠르게성장하는 문화 및 산업분야로 자리매김하고 있다. 이러한 e스포츠의 급격한성장은 동시에승부조작, 선수인권 침해, 불법 프로그램사용, 도핑, 지적재산권 분쟁 등 다양한 윤리적 문제들을 야기하고 있다. 이 논문은 e스포츠의 건전한 발전과 지속가능한 생태계 조성을 위해 현행법제도 및 스포츠윤리환경을 심층적으로 분석하고, 이러한 문제점들을 해결하기 위한 법제도적 개선 방안을 제시하는 것을 목적으로 한다. 국내외 사례와 스포츠관련 법령의 스포츠윤리 강화를 위한 규제 현황을 비교 고찰함으로써, e스포츠의 특수성을 반영한 실효적인 윤리 강화 방안을 모색하고자 한다. 이에 따른 결론으로 e스포츠의 윤리 강화를 위하여는 기존 스포츠관련법령에서 적용되고 있는 스포츠윤리나 스포츠비리 근절을위한 정책의 적용대상이 될 수 있도륵 제도권의 범위 내에 포함되어야 할 것이다. 현재 체육단체인 한국e스포츠협회에 가입되어 있는 e스포츠 종목사의 가입의 확대를 통하여 ｢스포츠기본법｣및 ｢국민체육진흥법｣에 따른 스포츠윤리 및 스포츠비리의 적용될 수 있도록 하여야 할 것이다.

esports has established itself as a rapidly growing cultural and industrial sector worldwide, transcending the realm of mere leisure activities. However, this rapid growth has also given rise to various ethical issues, including match-fixing, violations of player rights, the use of illegal programs, doping, and intellectual property disputes. This paper aims to analyze the current legal system and sports ethics environment in depth to promote the healthy development of esports and the creation of a sustainable ecosystem, and to propose legal and institutional improvements to address these issues. By comparing and examining domestic and international cases and the current regulatory status of sports-related laws aimed at strengthening sports ethics, this paper seeks to explore practical ethical enhancement measures that reflect the unique characteristics of esports.
