대학스포츠의 새로운 거버넌스 구축을 위한 입법적 개선방안 - KUSF의 법정법인화를 중심으로 -

Legislative Measures for Establishing New Governance for University Sports

엘리트중심의 성적지상주의, 학생선수의 학습권 침해, 입시비리 등 대학스포츠가 안고 있는 병폐를 해결하고자 대학이 주체가 되어 한국대학스포츠협의회(KUSF)가 출범하게 되었다. KUSF는 문화체육관 광부산하의 비영리사단법인으로서회원 대학간의 현안에 대하여 협의와 연구및 조정을 통해 자율적으로 사업을 운영하는 기관이다. 교육적 가치를 실현하고 학생스포츠선수의 육성을 추구하기 위한 중앙정부 차원의 전담 조직이 부재한 상황에서, KUSF는 회원 대학 상호간의 수평적 소통관계를 통해 자율성과 독립성을 기반으로 대학스포츠의 중심 거버넌스 역할을 하고 있다. 대표적으로 대학 스포츠의 핵심역할을 하는 대학 운동부의 평가와 지원을 비롯하여, 학생선수선발 및 학사관리정상화, 대학스포츠 교육 강화, U-리그 주체 등 다양한 사업을 수행하고 있다. KUSF로서는 비영리사단법인이라는 법적 지위가 장점으로 작용하기도 하지만, 재정적 불안정성, 사업의 확장성과 지속가능성 여부, 비영리사단 법인으로서 공익사업 수행 자격의 적절성 등 여러 한계점과 문제점을 안고 있다. 이를 해결하기 위한 방안으로 법정 법인화를 추진하는 방안을 모색 중이다. KUSF가 법정법인으로 전환되어야 할 필요성과 그에 따른 기대효과를 고려할 때, 법정법인화의 당위성은 충분하다고 본다. KUSF의 법정법인화를 통해 기관의 독립성과 위상을 비롯하여 사업의 체계성과 전문성을 강화할 수 있으며 무엇보다 안정적인 재원확보가 가능할 수 있다. KUSF의 법정법인화가 대학 스포츠의 새로운 거버넌스 체계를 구축하여 대학스포츠의 정상화와 선진화를 위한 기회가 될 수 있기를 기대해 본다.

University sports were plagued by ills such as an elite-centered, performance-based approach, violations of student-athletes' right to education, and college admissions corruption. To address these issues, the Korea University Sports Council(KUSF), led by universities, was launched. As a non-profit organization under the Ministry of Culture, Sports and Tourism, KUSF operates various projects addressing pressing issues among member universities. There was no central government-level dedicated organization dedicated to both realizing educational values and developing student-athletes. The KUSF serves as the central governance body for college sports, fostering horizontal communication among member universities and fostering autonomy and independence. The KUSF carries out various projects, including evaluating and supporting university athletic teams, normalizing student athlete selection and academic management, strengthening university sports education, and operating as the U-League organizer. The KUSF's legal status as a non-profit organization also provides the KUSF with the advantage of autonomy and independence. However, it faces several limitations and challenges, including financial instability, the scalability and sustainability of its business, and the appropriateness of its status as a non-profit organization to conduct public service projects. In particular, the National Assembly's audit pointed out the lack of legal basis for KUSF's budgetary support. To address this issue, the proposal for statutory incorporation is being pursued. Considering the necessity of KUSF's conversion to a statutory incorporation and the expected benefits it will bring, statutory incorporation is clearly warranted. If KUSF becomes a statutory incorporation, it will enhance the organization's independence and status, strengthening the system and expertise required to carry out its projects. In particular, the legal basis will enable the securing of stable financial resources. It is hoped that the statutory incorporation of KUSF will establish a new governance system for university sports. It is hoped that this will serve as an opportunity to normalize and advance university sports.
